AntiWORK immediate resign, contract bond / no actual money stated

I only worked for 2 days, and my body and my mind can't keep up with the daily commute and stress im having. got fatigue, and namaga ang lower body ko. might be really sound weak to some, but I need to rest kesa naman ipilit ko.

I dont want to continue work, it would really affect my performance. i want to quit but the contract stated bonds, (no actual value of money stated though). will they go after me if i immediately resign? and dont want to render the 30 days because i really cant take it anymore.

I also dont need to turnover since no equipments were given and i dont have that much role on my work, i just follow my apprentice.

will the HR accept my reason? help a girlie out.

If there is a contract bond but no stated value, I don't think it will stand.

Under Article 1306 and Article 1308 of the Civil Code of the Philippines, contracts are governed by the principle of autonomy and mutual consent.

  • A contract bond is a special obligation (a penalty or liquidated damages clause) that restricts an employee's freedom to leave for a specific period, usually to recover training or recruitment costs.
  • Because it imposes a monetary penalty or restriction on the employee, it must be expressly stipulated in writing and accepted by both parties before or at the time of perfection.

An employer cannot unilaterally impose or enforce an unwritten, implied, or retroactively added contract bond.

So can you resign? Yes, absolutely. May habol ba sila? Unless may signed document ka na nagse-state ng value for early termination, no, wala dapat. And if habulin ka nila about dyan, then exercise your right and present the necessary documents, so review mo muna ulit lahat ng signed mong onboarding documents para 100% sure.
