Advice

My brother got a call yesterday from a cop that he is being investigated for an identity theft fraud from a job that he left 6 month ago and might be sent to the DA. No prior record, not even a ticket. He has a good job and just got another job and in the process of background check. he tried his best to do the right thing. He had issue at his old job with a lot of co worker being their supervisor. He has been sad, suicidal since yesterday. He reached out to a lawyer who said they are still investigating and ask him to pay 8000. He is panicking and he doesn’t even live in the state he was being investigated anymore and don’t even know what this is all about. What can he do and how can we best support him, we are really worried about him. Please any advice will be appreciated. The cops called and text him also and he was pretty rude on the phone and started making accusations.

He can stop talking to investigators, detectives, anyone. Dont make their case for them. Their job is to get an arrest. Theyll make his comments fit the holes in the case. If they had evidence, they wouldnt be calling him asking questions, they would arrest him. Tell him to STFU.

He should stop talking to the detective, by phone or by text, and let a lawyer handle all of it from here. Anything he already said can be used, so nothing more without one.

Right now this is an investigation. Nobody has charged him with anything yet, and it may never get to that point. The lawyer should be licensed in the state where the investigation is, since that's where any charge would be filed. Before he pays $8,000, it's fine to call two or three other defense lawyers in that state and compare, and ask whether they'll contact the detective for him now.

Since he's saying he's suicidal, please don't wait on that part. In the US he can call or text 988, and so can you if you're worried about him tonight.

Not legal advice.

Retain an attorney. Do not talk to investigators. Let your attorney talk for you.
