I fell off my balcony

I went out to have a smoke and leaned on the railing like I have been for years and the structural paint finally gave way. Glad I didnt land on the jagged upright piece. Ive complained several times about the rust to management before. I dont know how to go about sueing them or if its even worth it atp.

Do you have records of telling them about the damage? If so they’re on the hook. Def talk to a lawyer.

Tough one if they’ve reported it before, unless they’ve got proof the manager said it was fine. Knowing there may be an issue reduces the responsibility for a legal action.

Also, why would you lean on it if you knew it was rusting. That doesn't change it should've been fixed but seems like OP knew it was a problem. Just happy they didn't get too hurt

Either way best to talk to a lawyer and see

Totally. $2k is better than a kick in the nuts, unless that’s what you’d pay for anyway.

Unfortunately I only spoke with them in person at the office a few times. The lack of documentation is entirely on me tbh

Does that really matter? In a sane country you actually have to maintain essential safety features and if something happens the liability shouldn't be on "was this reported?"

A railing doesn't rot away in a year so it's sensible to expect them to be liable for it even with no report.

you do not need to have a record of having warned them, they should have known, honestly go to a few lawyers and listen to them all then pick one you like.

They might be in luck if an inspector noted it.

it's only worth it if the possibility of having any medical care paid for and the management held legally accountable sounds good to you:) talk to a lawyer

Written complaints mean a payout is coming

I would be more worried about where you are stepping.

This would be enough for me to call the non emergency fire department. And ank them to inspect all the fire escapes asap.

You can send them the pic. They should send the right inspector.

And yes. Please file a police report seperately for injury. You need it for your records incase you have any injury later.

That aint even the worst lol. This is the state of the floor about 2-3 feet to the right of my pictures

Duuude.

It's gonna go soon. And that's been there a while.

Please don't even smoke underneath it. Is your car under that thing?

It almost looks like they cut it at some point and just couldn't be bothered to weld it back together.

There's no way they didn't know this was shot. It's supposed to be able to support 200 pounds in any direction. That was barely holding itself up.

About once every other year some guys come by, cut out the most rusted pieces, and weld in new pieces in their place. This one clearly didnt take

Aside from all that, are you up to date on your tetanus shots?

Maintenance should have been keeping a closer eye on the external structures which includes balconies, walkways, steps, etc. and informing management of things that need repair or replacing.

Glad you're not hurt!

I didnt get cut fortunately. It bent over kind of in slow motion with just enough time for me to grab the rail bars behind/beside me and kind of upright myself on the way down so I landed feet first and kind of amaturely rolled sideways and slammed hard onto my side and shoulder. Knocked the wind out of me for good couple of minutes though

Get video of this before it disappears!

Ask the neighbors downstairs with a camera.

Usually unless there’s damages you can’t sue.

So if you have medical bills from it, they would probably be forced to cover those with a stern word from an attorney. Otherwise, unless they do something like refuse to replace it, I don’t see a way to get money out of it the way some people are suggesting.

Please avoid all responsibility. You shouldnt be responsible for a toaster.

17

u/magpepper 2d ago

Wow, bit of a weird reaction.

You doing okay?

-18

u/LegoTurtle 2d ago

If you dont understand that the owner has a requirement over the infrastructure that is present and designed for safety, I dont know how you get by.

18

u/magpepper 2d ago

And if you don’t understand that there have to be financial damages in order to get money in court, you don’t understand how the law works 🤷‍♀️

Pain and suffering is a damage however. Emotional stress yada yada. This is an ambulance chasers dream.

after he finds a lawyer...the lawyer will send him to many dr.s looking for damages........what are you talking about?

u/Big-History-8457 2d ago

Please consult an attorney. This is lawsuit worthy.

Since you did this daily.  It kinda reminds me of the story of "Garry Hoy".  You weren't trying to prove a point about safety.  But the repetition of leaning against the railing slowly destroyed the integrity of that high grade rust.  If you've never heard of him.   I suggest looking him up.   Launches himself out a high rise window because he would demonstrate to others how safe the glass was by running and jumping into them.  One day, the metal framing gave way and there went Garry.   The glass landed next to him, details say it didn't break.  So Garry was correct.  But that metal, probably should have considered it.

But my rent went up. Filthy landlords.

Please don't brush this off, you could have been seriously hurt. Definitely keep records of all your complaints.

If there are other railings like this on a multi-unit building and the others are in similar condition, other tenants will want to hear your story and perhaps make the complaints rise in volume. Fixing it before those complaints reach the ears of a government inspection will become a high priority.

Yep, gather all your records and what happened and call a lawyer

Time for a personal injury lawyer!

2

u/AGrandNewAdventure 10h ago

You're incredibly lucky you didn't land on an upright piece of metal railing!

2

u/slowtoke420 2d ago

sue and sue hard especially if it's already a problem you brought to their attention

1

u/QuickSquirrelchaser 2d ago

Go contact an attorney. They will consult for free about civil cases like this. If they recover money they take a percentage. If they don't, you pay nothing.

1

u/Any-Square-6595 2d ago

Should have seen that one coming

1

u/JayD3vo 2d ago

I guess smoking can kill in other ways.

1

1

u/Medical_Talk_1309 1d ago

Money hungry fools in here. He was negligent, leaning against a railing he's complained about multiple times already, falls and doesn't suffer any injury, and now everyone says sue them. Sue for what damages? Immoral in my opinion. Negligent actions have consequences. Stay in your bubble wrapped apartments ding dongs.

1

u/tinynebulaamber 2d ago

If you have written paper trails of complaining to management about rust before this, a lawyer is going to love your case.

0

u/Cautious_Series_2567 2d ago

If you did fall this post should be on the " win the stupid prize" Reddit thread! It was more than obvious for a long time that the railing was failing.

1

u/Fr05t_B1t 1d ago

Honestly though. It’s sad that people only react to problems once it affects themselves rather than preventing it for everyone. And some to all the other tenants.

u/DiscussionWeak2318 2d ago

Sue. Sue. Sue. Sue. Sue. Sue. Profit

0

u/pyrotechnicmonkey 2d ago

generally you should talk to a personal injury attorney or similar and usually you can get at least a free consultation. Many of them will work on contingency and only charge you from any settlement they win.

Unfortunately though you might not necessarily have much of a case. This is not the sort of thing that causes emotional pain and suffering and you're really limited to your actual damages. this means being reimbursed for stuff like medical expenses if you have to visit a doctor or get some sort of treatment. It's still worth checking

u/anonymoo5e77 2d ago

Are you injured? If not, why would you sue? You’ll waste your own time for a tiny payout. If you are injured then it might be worth it.
