Canadian engaged to US citizen, immigration query?

Hi folks,

I'm a Canadian citizen, engaged to a US citizen, and I qualify for TN. We're having a wedding ceremony with rituals in February 2027. My main goal is to cut the wait and live and work together in the US as soon as possible. I may apply for a green card later, but I haven't decided when, and I'm not in a rush.

On TN, my concern is the temporary intent requirement. If I enter engaged, with the legal marriage planned 6 to 12 months later and no filings until then, what's an honest answer if the officer asks about my plans? I'm also unsure whether the ceremony itself would make us legally married that day, even unregistered, since entering already married seems much harder to defend. Has anyone entered on TN in a similar situation, and how did the border conversation go?

On K-1, it looks like roughly 12 to 18 months with me outside the US the whole time, and I'd have to marry within 90 days of entry. I'm happy to forego work until the work permit comes through, but the forced marriage timeline doesn't match my plan. Is it worth the wait for the lower risk compared with TN?

Finally, are there any other options worth exploring?

Would you speak to an immigration attorney before entry, and any recommendations for cross-border cases? Thanks. I know this isn't legal advice, I'm just sanity-checking my plan.

Many thanks!

Cancelled CPT (never started) not listed on OPT I-765 - anyone had a similar situation?

Hi all, looking for reassurance or similar experiences.

Background:

- F-1, Master's program (ends Dec 2026)

- Summer 2026: my DSO approved full-time CPT for Company A. About two weeks before the start date, the offer fell through and I got an offer from Company B.

- My DSO cancelled the Company A CPT in SEVIS before it started and issued a new CPT I-20 for Company B. I never worked a single day for Company A.

- I completed the Company B CPT as authorized (about 3 months full-time).

When filing my OPT I-765, I asked my DSO whether to list or explain the Company A CPT. She said that since it was cancelled in SEVIS, I only needed to upload the Company B CPT I-20. I followed that, listed only Company B, and submitted in September. My application is now pending.

Questions:

  1. Has anyone had a CPT cancelled before the start date and left it off their I-765? Did you get an RFE or any issues?
  2. Is there anything I should prepare now (for example, keeping the old I-20 or my DSO's email) in case USCIS asks?

Thanks in advance!

CSPA Question – F2B to F2A

Looking for input from anyone with CSPA experience, especially an immigration attorney.

My family member’s I-130 was filed while she was under 21, but USCIS approved it after she turned 21 and the case was sent to NVC as F2B. After subtracting the roughly two years the I-130 was pending, her CSPA age appears to be under 21.

Can NVC apply the CSPA calculation and change the visa category from F2B back to F2A? If so, would NVC then determine visa availability using the F2A category? Her priority date would be current/eligible if she were classified as F2A.

NVC currently says they cannot review CSPA because no visa is available under her current F2B category, which seems circular since the purpose of the CSPA review is to determine whether she should actually be F2A.

Has anyone dealt with this situation or know how NVC normally handles it?

J-1/J-2 Health Insurance Gap for 2 Days. Could This Affect Our Visa Status?

My wife and I are currently living in New York City. She is in J-1 status and works as a research associate at a medical center, and I am in J-2 status.

We are trying to extend our health insurance coverage for one additional month. Unfortunately, we have had difficulty finding a suitable insurance plan because several providers do not accept applicants who are already living in the United States, particularly in New York.

My main concern is that we might have a two-day gap in our health insurance coverage while arranging a new policy.

My questions are:

  1. If our insurance expires, what are the potential consequences of the two-day gap?

  2. Could such a short gap lead to termination of our J-1/J-2 exchange visitor programs or affect our immigration status?

  3. Could this affect my wife’s employment at her institution?

  4. Are there any other insurance providers that accept J-1/J-2 holders who are already living in New York and need only one additional month of coverage?

I would really appreciate hearing from anyone who has experienced a similar situation or has knowledge of the regulations.

I’ll apply to the US lottery 2027 but I have a concern

I’m an international medical graduate from Jordan and am currently doing my internship. I’m applying for postdoctoral research fellow or research scholar positions in the U.S. on a J-1 visa, hoping to start in July 2027. However, I haven’t secured a position yet, and I’m considering entering the lottery in the hope of winning, since most positions require U.S. citizenship or a green card. My concern is whether applying for the lottery and not being selected will harm my chances of getting the visa, as it could imply that I intend to immigrate.
Thank you all. I’d appreciate any advice.

Marriage-Based AOS Stuck Because Asylum Office Has My A-File? 14 Months Waiting. Please Help!

Hi everyone!

I'm hoping someone here has experienced something similar because even my lawyer hasn't seen a case quite like mine. I'll try to keep it short.

My timeline:

  • 2020: Applied for asylum and waited 5 years for an interview.
  • Feb 2025: Got married.
  • Aug 2025: Applied for marriage-based AOS (I-130 and I-485).
  • Nov 2025: Asylum interview scheduled, but my asylum lawyer successfully postponed it to prioritize my marriage case.
  • Jan 2026: Attended my marriage-based AOS interview. Everything went smoothly, but both cases remained pending with no decision.
  • Feb 2026: Apparently, my A-file was transferred to the Asylum Office (I only found this out later).
  • July 2026: Asylum interview rescheduled. My lawyer tried to postpone it again, but asylum office refused. I attended, and my asylum was approved on July 31!
  • July & Sept 2026: Requested congressional inquiries regarding my pending marriage-based AOS.

Here's where things get confusing.

In September, I received this response from USCIS through my congressional representative:

"Our records reflect that the constituent's A-file has been with the Asylum Office since February 2026. On July 31, 2026, he was granted asylum.

His A-file will be returned to the Field Office in due time. Please note that the family-based Form I-485 is well within normal processing times."

My questions are:

  1. Does this mean USCIS hasn't been processing my marriage-based AOS because the Asylum Office has my A-file?
  2. Why hasn't the Asylum Office returned my file after approving my asylum? Is there any way to contact them and request that they send it back?
  3. I'm now at 14 months since filing my AOS and almost 9 months since my marriage interview. Should I consider sending a demand letter, or is there something else I can do?

I know I can apply for a green card based on asylum one year after approval, but I've already invested so much time, money, and energy into my marriage-based AOS that I really want to see it through. And also I know the green card based on asylum is taking years to get resolved.

I'm honestly exhausted and extremely anxious. After almost 7 years dealing with immigration, I find myself waking up in the middle of the night just to check my USCIS account.

Has anyone experienced something similar, especially having asylum and marriage-based AOS pending at the same time?

Any advice or personal experiences would mean a lot. Thank you!

U visas
While pending u visa I have no status currently 1 am planning gain status. Such as either studying or getting employment base status. Am I able to adjust my status. Or add status? Been waiting for a long time and tired of waiting
I have come here with legal status and did my opt currently I have come to end. Since then I am waiting an update to my u visa. I have believed to my lawyer he told me it will take 5 years maximum to get my u visa but it is almost 4 years I haven't received anything.....
I want to restart my life again from somewhere either attending college for master degree and trying to obtain EAD this way or 1 am considering EB category and push my limits such as EB-1, EB-2, EB-3 or anything whatever gives me status.
What are my options? Did I commit unlawful presence or out of status? Is there any forgiveness?
I know it is super complex case but there should be a light. Since u visa has the most forgiving and flexible path. What are my options am I able to receive another status while waiting the u visa result?
Please if you have a knowledge feel free to share

DV 2026 any hope?

hi everyone, so regarding Medani:

''Medani v Trump DV-2026 Updates: First, Judge Davila has issued an order allowing the 10-day adjudidcation period to resume October 14, 2026 at 12:01 a.m. (local time at embassy).

Further, he has clarified that “Applications” are defined as all DS-260 Forms successfully submitted. This will hopefully mean we will see at least some 2NLS for DV-2026 applicants who have not attended interview. Further, he ordered that DOS needs to send a copy of his order to embassies with their guidance cable.''

Please let me know if any Dv2026 winner got their re interview date.

is there any way to hire someone to be a co sponsor for 864?

My regular income and taxes don't show much money coming in, but I have 100k in cash in the bank, which I'm afraid may not be good enough to sponsor my wife. I'm wondering if anyone knows of any services out there to hire a sponsor?

Is this good enough for my 864

My last two tax returns show a net loss. I made 70k but I had approximately 70k in expenses. However, I have a letter from the bank showing that I have $91,000 in my account. I also have a fully paid off property with the tax value of $50,000. My first 864 was denied, but this was before I had the $91,000 in the bank. Can anyone confidently tell me the best way to make it over this sponsorship hurdle and help my wife get her green card.

EB-3 Sponsorship from Algeria

Hi everyone! I’m an Algerian citizen living in Algeria with a Master’s degree in Artificial Intelligence.

I’m exploring the EB-3 visa pathway and am open to both tech jobs and entry-level positions.

Has anyone successfully obtained EB-3 sponsorship while living outside the US? Are employers or agencies such as MCC USA or BDV Solutions legitimate options for applicants from Algeria?

I’d appreciate any real experiences, verified job links, or advice. Thanks!

US Non-Immigrant Visa - Waiver of Inadmissability Query

Hi Everyone,

I have 2 historical convictions for Assault Occasioning Actual Bodily Harm (ABH) and wish to travel to Florida for a holiday. The first was 30 years ago and resulted in a conditional discharge, and the 2nd was 23 years ago and resulted in a 6 month custodial sentence.

I've since got my act together and now have a good career, a family, and no further offences have been committed.

As a result of these historical offences, I've decided to apply for fir a non-immigrant visa rather attempt to use ESTA, and would really appreciate any help that anyone can give with the following queries?

- If I'm deemed inadmissable, I would hope to be recommended for a waiver. Do you think there's a reasonable chance this could happen given the circumstances described?

- Does anyone have any experience of having a waiver granted or refused?

- Does anyone with recent experience, know how long these waivers are taking to come through at the moment? I'd be applying in London.

Many thanks in advance.
