In California, sick time is required and must be separate from PTO. Even places that offer “unlimited” PTO have to give you a separate bank of 5 sick days per year.
That's not really true. You can offer PTO only, but you have to allow it to be used in a way that meets the requirements of CA sick leave law. Source - Am HR in a credit union with PTO. Realistically it's a PITA to do, and we're planning to move to separate Vac/Sick banks soon.
Its true that by law all employee accurre sick time in CA, but its not true that it has to be seperate. Essentially you can combine pto and sick leave as long as its greater than the 2hrs a paycheck specified in the law. I believe the minimum hrs for sick leave for a FT worker is 40 hrs.
Unlimited pto companies get around it by just saying unlimited pto and sick leave. No matter what, unlimited is a scam.
I mean also just colloquially unpaid time off is sick time. I've never taken PTO because I've never been paid time off. Called in sick though. Some days you just can't do it and if they don't give you paid sick time honestly bet you could get the same job somewhere else by the end of the week if they cared enough to fire you
This is crazy. I'm in the UK public sector. I get 35 days leave a year (36 next year as I earn a day every year I work here up to 7 years). I also get TOIL and 6 months of full paid sick leave followed by 6 months of half pay.
Pto and sick time together are definitely both a thing. I worked at a place that offered extremely generous hours for both, the caveat being that we were required to work all holidays and weekends. I really liked that trade off. I legit couldn't even spend all my pto, I always had at least 60 hours spare lol.
Oh I know it's a thing, my dad talks about it all the time. It's just wild that I've never had a job that seperates them. It's always just been 1 bank of paid time off which is used for either sick time or vacation.
I'm in a weird spot where as an intern I was hourly and accrued sick time based on state minimums (a California W) but when I converted to full-time I was out on salary and this only get PTO. But, I kept all of my Sick Time and was allowed to use it, so it was basically a free 3 days or so of PTO lolol.

Never worked at a place that gave me PTO and sick time. It's always just been PTO.
