42, Making $150K, Drowning in Debt and Feeling Hopeless. Need Advice

I’m 42 years old and honestly feel like I’ve completely ruined my financial future. I’ve worked hard my entire career, but I’m now in a situation where I don’t see a way out.
Here’s my situation:
Income: $110K salary (recently cut from $130K), plus approximately $40K in consulting income that isn’t guaranteed.
Debt settlement: $24K remaining, paying $605 biweekly.
Credit cards: Approximately $10K in additional debt.
Mortgage: $297K remaining on a condo I purchased earlier this year.
Car loan: $29K remaining.
Taxes: Potentially significant IRS debt for 2025 and 2026 due to errors in my self-employment taxes.

Despite making a decent income, I’m barely breaking even each month. If I lose my consulting income, I’ll be approximately $2K short every month.
I’ve considered selling my condo, bankruptcy, and finding additional work, but every option seems to create another problem. I’m especially worried about the IRS because they generally don’t factor unsecured debt payments into allowable living expenses.
What’s affecting me most is my mental health. I wake up every morning overwhelmed with anxiety, worrying that I’ll never recover financially. I’m single, want to eventually find a partner and build a life with someone, and feel like I’ve completely derailed my future.
I’ve tried talking to my family, but I don’t think they understand how bad things have gotten. I’m feeling genuinely hopeless.

Has anyone been in a similar situation and managed to turn things around? What would you do in my position?

I’m not looking for judgment. I know I’ve made mistakes and take responsibility for them. I could really use some practical advice and perspective from people who’ve been through something similar.

Would you get a 401(k) loan?

So my husband and I are separated but still living together because we need to pay off about $23k in consumer debt before we can collectively afford for him to move out.

Currently, I have a 401(k) loan that is almost paid off and I will have the ability to get another one in November, I am estimating I might be able to gat a loan of about $9k. Some of our debts are either high interest, or they will begin to accrue interest soon because they’re currently on a promotional balance. So I’m trying to find out whether it makes sense for me to get another 401(k) loan to pay some of this off before that happens, or if it makes more sense to keep the money in my 401(k).

Here are all our debts, approximated:
$8700 - his car loan (16% interest, $290 a month)
$4400 - my car loan (0% interest, $210 a month)
$700 - his CC1 (28% interest, $25 a month)
*$2000 - his CC2 (0% until February, $25 a month)
$500 - my CC1 (28% interest, $25 a month)
*$3000 - my CC2 (0% until September, $28 a month)
*$3700 - personal loan (35% interest, $135 a month)

I’m picturing a few different scenarios here
1- I can pay off the three debts that are asterisked. This saves us about $200 per month in monthly payments but saves/protect us from a lot of interest in the future.

2- we can pay off just his car loan and potentially the two smaller credit cards “CC1” which would save us about $340 per month in monthly payments. Then we’d have more money to contribute towards the credit cards that are currently on promotional interest but it doesn’t help with the high interest personal loan.

3- I don’t take out the 401(k) loan at all because even though it’s basically zero interest, it’s still more/different debt.

4- Another option??

Are They Likely To Appeal?

I defaulted on some private loans years ago and they were bought by a debt buyer. The debt buyer has used the same law office for all the loans. All of these loans were from the same company and likely bought in a batch together since I defaulted on them all at the same time.

Loan 1 - sued for last year and I hired an attorney named “Z” who won against them because they didn’t have the paperwork.

Loan 2 - sued for 3 months ago and their attorney withdrew it at the last minute. “Z” entered an appearance for that one. It was a low amount. They wasted $250 on court costs.

Loans 3,4,5 - sued for a week ago and their attorney didn’t show up for court. Got a default judgement in my favor on them all. My attorney “Z”went to the hearing. I’m not sure if the plaintiff attorney didn’t show up due to the date getting rescheduled and maybe their secretary messed up? I’m confused why didn’t show up instead of withdraw? They spent $750 in court costs for these 3.

How likely do you think it is they’ll appeal? My attorney is out for a week for a medical procedure so I can’t ask him. I guess I’m also confused why they didn’t show up/withdrew after spending all that money on court costs.

Capital one closed my secured cc account

I just received this letter in the mail…“We are closing this account because Capital One has observed activity on one or more of your Capital One accounts that is inconsistent with typical customer account usage.” So they are closing my $200 secured credit card. The balance is paid in full but will this still be a negative mark on my credit report?

Life happened, now I’m lost.

My parents died when I was 19, I’ve been on my own since learning mostly by experience, the most expensive lessons. I have no one to turn to for advice and no clue what to do. I did fairly well worked my way into a specialty field in municipality water systems. Was making $125-150k a year, until some federal budget cuts cancelled virtually all our projects in my field. I lost my job and ultimately the business closed after I was let go. I received some UE but it ran out long ago and I still haven’t any job offers in my field. Due to my specific field and the federal cuts it’s overrun with unemployed older folks with much more experience, and younger ones that will work for less. I quit paying on all my credit card debt, about $70/75k and a personal loan around 10k. Sold the house so it didn’t go into foreclosure, bought a class A coach and hit the road to find my new life and career. I‘ve been living in it doing jobs working my way around the country with no permanent address trying to find my place. I’ve found a dream job and chose a career that only makes about $45k a year, but is much more fulfilling and contributes to others in a way that has changed me forever. As you might figure, there’s no way I can live and pay all my old debts. I haven’t made any payments in almost 2 years. Most of the accounts went to charge offs, and/or sold off. I’ve just continually blocked all numbers any one calls from. Over 1,000 numbers at this point. I’m lost on what to do, do I declare bankruptcy and go through all that, or just wait for 5 more years for all of the debt to fall off?

tldr $75k in CC debt, no payments in almost two years. Claim bankruptcy or let it all fall off in 5 years?

Got sent to collections for medical bill I didn't know about

hi. I just checked my apartment mailbox for the first time in months and saw that I received a medical bill back in February from the lab at my family's doctors office. I paid my bill from my visit that day not the online portal assuming that was all I owed. I never got any calls or anything from the lab indicating that there was a separate fee. the bill is over $1000 and I have several letter forms the labs and from a collections agency.

I have no idea where to start with this. Will my insurance cover it? I have no idea why they never tried to contact me any other way.

edit: I wrote this post frantically and I apologize if it appears to be all over the place.

After calming down and looking into this some more, the lab within my doctor's office submits their bills separately. After my doctor's visit, I received my EOB from that visit and paid the appropriate amount the day that I received the bill. I wrongfully assumed that the EOB from that doctor's visit included my lab work.

The lab has billed my insurance directly for every visit after that initial doctor's visit so I assume it was an error on their end with billing at that visit. I will contact my insurance and my doctor's office on Monday to see if they can refile this bill correctly but as many in the comments have communicated, I might be a little (or a lot) too late. Regardless of the outcome, I am prepared to take full responsibility for my failure to act in a timely manner.

I appreciate the kindness (and tough love) I have received in the comments. Thank you for all of your help. Lesson learned, check your mail.

Debt Relief Programs? Any advice?

Hello, I was looking to see if anyone had any suggestions on a specific debt relief program they have used or heard good things about?

I have about $50K high interest debt across multiple credit cards and personal loans. I made a lot of mistakes and poor judgment calls.

When I broke down where I stand with making payments on everything…I realized I’m in the hole each month. I’ve been living paycheck to paycheck check to pay check for a long time and I would really like some relief to be able to start saving again.

Forgot about a debt collector from 5 years ago for a small medical bill and they haven't contacted me since. Do I just let it go?

It was a $20 bill (after insurance coverage) from a dentist visit in college. I paid it in the office and had a receipt, but then 2 years later in 2021, a legitimate debt collector reached out saying it was unpaid. They sent me something in the mail showing where the debt is from and the amount. I called the dentist office about it. Turns out, insurance didnt fully cover what the estimate said it would, and I still owed a $39 balance and they sold it off to that collection agency. I never got that bill from the dentist.

I was pretty confused but I gave the agency my info to start the repayment process, and they sent me a letter in the mail with only a phone number and QR code to a website to send the payment through. That seemed extremely sketchy so I never paid it and they've never contacted me again. It made me think they were a fake agency or something. They only ever reached out through phone and email and I haven't heard anything in 5 years now. My number and email never changed, and my old roommates said they never got any mail from them.

Do I just forget about it at this point? It's not on my credit report and legally I don't think it can be even after I pay it off, both because of how small the debt is and the fact that its medical. I live in Minnesota and I know there's rules about how long debt collectors can ask for payment, but I can't tell which laws are currently in place.

Stay away from debt settlement/consolidation companies!! **Five lakes law firm**

I spent 13 months in a debt settlement program. Here's exactly where my $8,700 went.

I'm posting this because I wish someone had shown me real numbers before I signed up.

I enrolled in a debt settlement program in September 2025 and canceled in October 2026. My payment processor statement showed:

- $5,022 went to my creditors (settlement payments)

- $3,570 went to settlement fees

- $145 went to monthly and setup fees

The fee was 27% of my enrolled debt. When I canceled, the remaining fee was taken from my account balance, including my last two deposits, so I got nothing back at cancellation.

What I learned the hard way:

  1. **You can call creditors yourself.** After leaving, I settled or set up payment plans directly, one phone call each, with zero fees.
  2. **Ask how the fee is calculated before signing.** Mine was based on enrolled debt, not on how much they saved me.
  3. **Settling hurts your credit.** Settled and charged-off accounts stay on your report for about 7 years from the first missed payment.
  4. **Some lenders never forget.** Creditors flags members who cause them a loss, and that can block future loans unless you repay the difference. I'm paying mine in full for that reason.
  5. **Forgiven debt can be taxable.** If $600+ is forgiven, you may get a 1099-C.
  6. **Get the payment processor statement.** It shows every fee line by line.

(THE 27% FEE IS CHARGED BASED ON YOUR DEBT AMOUNT NOT THE NEGOTIATED PRICE THAT WAS DONE WITH THE CREDITOR)

- For example:

$15,000 in debt

$7,000 negotiated amount

$15,000 x .27 = $4,050

$7,000 + $4,050 = $11,050

Basically I saved only $3,950

The 27% fee is times by EACH creditor amount you have.

Not financial advice, just my experience. Happy to answer questions.

$197k CC debt and $97k tax debt. Bankruptcy or not? Please read.

I was doing very well for myself up until 2024 when my health took a turn and I was hit with one thing after another. I was carrying debt from Covid but was aggressively paying it down.

Due to the health issues, I haven’t been able to work and I’ve gone through all my savings. I’m applying for SS disability, but they deny the first couple of times. I’m literally reaching a scary point in life but I do feel like it should come to an end in a year’s time, maybe two. One thing I’ve always been good at is making money. The problem is one of my health issues is interfering with my sleep for the last 5 years and I can’t even think, remember, clearly right now.

I was told that when you’re on disability, debtors can’t go after you because SSD is not considered income. So, I haven’t filed for Bankruptcy because I tell the collectors I’m going on disability blah blah.

My wife keeps asking me to file for bankruptcy now so it doesn’t affect me too long. I don’t know what to do. It’s probably because I can’t think clearly.

Should I file or just keep telling the debtors that I’m filing for disability?

Any advice will be appreciated.

Midland Credit Management

Hello,

Recently my mom received a letter from MCM. From the research ive done this is a legit company that buys debt from accounts that have been closed. They claim she opened a credit card with Credit One Bank back in 2018 or 2019 and the account was closed in 2019. She is in her 60s now and has no idea how to open a credit card. As of now we havent received any letter in the mail about a lawsuit but I believe someone must have opened this credit card using her information. As she called MCM and they asked her about an address they have on file which does not match the address we live in. Does anyone have any advice on how to navigate this? Ive also recently fallen victim to identity theft (its being handled) but never had a situation like this... any advice would be greatly appreciated!

Feel like I’m running out of debt management options

I am a single mom in a high cost of living state. My net is $100,000. Rent and daycare until August 2027 are $60,000. ETA: located in metro Boston

I have $32,000 of credit card and personal loan debt, not including a $2000 Affirm loan and $3000 to the IRS I pay monthly. Most of the debt is covering living expenses, in addition to impulsive spending, and unnecessary purchases over a couple years. I have no liquid savings And I’ve tried to take on two different side gigs, but the exhaustion proved to be too much.

My immediate issue is the monthly burden, and the second is naturally the long-term.

After taking a hard look at my expenses, creating a feasible budget for everything else, and cutting $400 in groceries and going out monthly, I’m still left with $1,000 in minimum debt payments a month.

I have explored two debt management companies who cannot move the monthly payment down much and have consulted a few lawyers about bankruptcy, I will not qualify for chapter 7 with my income, and chapter 13 seems incredibly complicated with fees, tax implications, the credit hit, and no guarantee the monthly payment will be affordable.

I have a consult on bankruptcy next week to determine the actual number on what I would need to pay monthly for chapter 13, but per my calculations, I need to be $500 a month to fit in my budget. I highly doubt I’m going to be able to cut the debt payments by 50%.

I don’t believe consolidation or loans will work, but I feel like there aren’t many options left.

Your thoughts insight are welcome, especially if you’ve gone through something making a great salary on paper, but not being able to make it work monthly nor find a long-term solution.

Thank you!

Apple Card Co-owner Ch. 7

I have filed for chapter 7 a few days ago. I am a co-owner (not authorized user) with my significant other on my Apple Card. Since he is a co-owner he is still responsible for making payment.

However, he cannot access account on wallet or online. When he contacted support they stated that since that they are unable to accept payment bc the received notice from the court about chapter 7. How should he go about this?

Question about Charge off

Hey, so I (23 year old Female& full time student) stupidly had three credit cards i used and did not pay back. Times got hard and I took a month long vacation without factoring in these payments. Anyway I’m settling the debt now. But I had a question. Discover is only offering me 35% off my original balance while CO is offering 60%. Is there anyway I can get them (discover) to discount me more ? I know it’s selfish but I’m just trying to rebuild!! Thankyou guys.

Jefferson Capital Systems & Indebted legit?

I had an account at PNC but left the US and never closed my accounts. I had money (not a lot) that probably got deducted across the years and now I owe money. I was notified via email that my account was transferred to Jefferson Capital Systems and now I’m receiving emails from Indebted with discount options to cancel the debt.

I called PNC, they couldn’t authenticate/validate my details as I have no longer a US phone number, also I couldn’t provide the last transaction date and amount (as I left in 2019 and haven’t used those cards since then, they also expired, never renew and I cannot even log into the bank app). I shared my SSN, but that was not enough. They advised to call Jefferson Capital Systems, I did and they confirmed the account was transferred in 2023. They told me to call +1 (800) 364-1895, which I see is associated to Delta Outsource Group and also Indebted.

I only want to get over this, pay the debt and forget about this. Has anyone gone through a similar process? Should I trust the emails I’m receiving from Indebted? The 65% discount is surreal but hey, I would take it.

Please share your experiences, tips, advices or suggestions!

Debt help?! Consolidation??

Help!? Has anyone done debt consolidation or know of any other debt relief ideas? We are in a crappy situation and need some relief as financial situations changed and just needing some relief.

Here is the break down..
Paid $22,000 for a car added on an extended warranty and made it become about $28,000

Car loan left to pay right now- $22,000
Worth around $17,000, maybe a little more/less.
So we are under water.

Car payment per month is - $595

We also have another $3000 personal loan we’re paying on.
$167/month

Credit score - low-mid 600s
Credit union will not refinance because we are under water and I believe when they ran things they said his credit score was on the lower side of 600.

We realize even if we did debt consolidation it isn’t helping us long term but we truly need the relief now.
We also understand his lower credit score isn’t helping matters and mines not great either. 😕
I’m open to all suggestions/ideas?! Our money is stretched so thin and we’re running out of options to keep things moving forward, we have 4 kids.
Ty! Please be kind.

Telecom debt - Lawyer

I live in Ontario, Canada. I have an unsecured debt(telecom) of $25,000 that went to a collection agency. The last date of payment on the account was Aug 15, 2025. I haven't had any emails, or calls regarding this account until last month.

I received an email before Thanksgiving from a lawyer/paralegal on behalf of the collecting agency in charge of collecting the $25,000 debt. Basically demanding payment, that they would accept a lumpsum payment of $16,000 to settle (I don't have). I have no employment income, for years now. I survive on child tax, trillium, and GST. I also have no assets. From my research it says I'm "judgement proof".

How likely would it be for them to actually go through the process of taking me to court? Or freezing my bank account? Or something along those lines. I have no other debt, it's just this that's coming after me.
