The colors are classic for the basketball team, so I'm surprised it took this long for the football team to wear them (though the threat of the Tennessee Titans suing them may have been a factor).

I like to imagine that Drake wouldn't have approved the uniforms without making sure they were on firm legal ground, especially given Drake's own recent trademark suit against DMACC. But who knows. I'm sure at least one faculty member from the law school told them they were fine.

If we really wanted to get into the analysis, we're in better shape than Houston was when they tried this simply because Drake already has an established history of using these colors (though not necessarily for football), and we're in a completely different state, so there's less potential for confusion. There are also a few distinguishing features (no numbers on the shoulders, no name above the back number, no tricolor stripe on the helmet, using an established mark for the Drake script on the helmet, maybe there won't be a tricolor stripe on the pants). We'll see whether or not that's enough.

Nice uniforms… and I wish them the best of luck in their conference but they are gonna get boat raced when they play Montana.
