MISC. A Virginia man inadvertently left his phone recording while he was under anesthesia for a colonoscopy, which captured audio of the doctors: mocking him, instructing a medical assistant to lie to him, and discussing giving him a false diagnosis of hemorrhoids. In 2015, a jury awarded him $500,000.

Do hospital gowns have pockets? How did he get a phone in the OR?

I recently had my colonoscopy and it really would not be that hard, it's not a prison where you're searched for phones. You get rolled into a dark room where they perform the procedure that takes around 15-20 minutes, then you're rolled out to resting area. i could have easily put my phone under my pillow.

I’ve had a colonoscopy as well and while your idea would get the phone into the OR, it wouldn’t have recorded much under your pillow.

some places your personal items bag comes with you under the bed because this isn't a full operation it's just an out patient procedure and is apparently easier for them to keep track of it since it just stays with you. some places put the stuff in lockers, is what it is. apparently he was using his phone to record post op instructions from the doc when the anesthesia kicked in. they stuck it into his bag (just a thin bag) and put the bag away but it was still recording.
