SOCIETY After a Brazilian mother caught her bf trying to rape her 11-year-old daughter, she spiked his drink then stabbed him to death while he was knocked out. She confessed to the killing, but said it was to save her daughter from another attack. The court & jury agreed; she was acquitted on all charges.

Furious mom Erica da Silveria Vicente — who castrated and killed her boyfriend for trying to rape her 11-year-old daughter — was freed when the judge dropped the murder charges.
The 42-year-old woman from Belo Horizonte, Brazil, had already spent a year in the slammer awaiting trial after admitting she killed her lover Everton Amaro de Silva.
The woman openly confessed to setting up her 47-year-old beau for slaughter after hearing her daughter screaming and catching him on top of the girl with his trousers down and his hand covering the girl's mouth trying to sexually assault the preteen, according to local outlet Estado de Minas.

According to case files finalized in March 2026, the incident occurred in the state of Minas Gerais. Mother Vicente caught her boyfriend, Everton Amaro de Silva, in the act of abusing her young daughter. Shocked and enraged, she intervened against the attacker, killed De Silva, then cut off his genitals and set his body on fire.
During the hearings, the prosecution argued that the incident was not a momentary fit of madness. The prosecution claimed that Vicente first incapacitated the victim with drugs and then carried out the attack, alleging the act was a "planned execution." However, these claims did not change the court's final decision.
The court panel and jury described the mother's actions not as brutality, but as a "natural protective reflex" displayed by a parent in a moment of extreme trauma. The ruling highlighted the following statement:
"A mother's reaction to the sexual assault of her child is a fundamental human survival and protective instinct. This has been accepted as a form of self-defense and an unavoidable reaction within legal boundaries."
Following this opinion, the court unanimously found the mother not guilty and ordered her acquittal.

Holy shit. “An unavoidable reaction.” Bravo 👏

12

u/Hour_Ad_7797 3h ago

“In a moment of extreme trauma.” Damn right!!!

7

u/BadHairDayToday 4h ago

Usually the issue with these cases is the proof. Did she really see that or is it a justification narrative that she is fabricating?

In this situation interviewing the 11 year old daughter seperately and checking the stories could be sufficient corroboration

19

u/RogueBromeliad 3h ago edited 3h ago

They probably did corpus delicti on the 11 year old, and it did show abuse.

Edit: The title of this post is completely wrong. She didn't spike the guy's drink. The guy was drunk, and after they both went to sleep the guy went into her daughter's room, and tried to rape the girl, and the girl started crying out for help, and when she got there she dragged the guy into the living room and stabbed him, cut off his penis, and with the help of another person they took the guy's body to the woods and burnt it.

There were other testimonies that corroborate her version, and in all of her interrogations she was consistent with the events that took place which indicates it was true, as well as they found sexually coercive messages from the stepfather to the daughter on the daughter's phone.

8

u/DayglowBimbo 2h ago

Important to highlight this, especially with the court panel arguing this was a natural protective reflex in the face of extreme trauma. The title of this post makes it sound like there was some level of pre-meditation, which would've made the argument of her actions being reflexive less valid.

According to the news articles I have read about this story, both the police and prosecutors say that she spiked the man's drink with klonopin. It doesn't make any sense that upon catching a man raping her daughter the woman then served the man a drink laced with drugs and then patiently waited for those drugs to kick in. However there are other news articles that say she first saw inappropriate sexual text messages that the man sent her daughter before this incident ever occurred.

meanwhile in the United States the perpetrators get elected to high office or get away with it if they have connections

u/djpiperson 4h ago

Surprisingly, in Brazil too, this was a particularly amazing exception

62

u/tehgimpage 4h ago

does it set a precedent for future cases to follow?

34

u/Left4Daft 3h ago

Kinda, but not quite. Brazil abides by civil law unlike common law, so interpetation is governed much more by the Penal Code than by local customs. It can be said that the particular circumstances of the crime allowed acquittal for self-defense of third parties, already regulated by law.

4

u/EarlyXplorerStuds209 3h ago

More like a President for cases to follow.

1

u/marilize__legajuana 1h ago

Not in an arbitrary way, but it certainly can be cited to try to sustain this argumant in similar cases in future

My great great grandma did something very similar to her second husband because he did that to my great grandma. I gave my 1st daughter her name as her middle name. I want my daughters to know you have it in their blood to take care of yourselves and your loved ones. They will always have that power. Her family will speak praises of her for generations because of the power she shown that day. I hope she is blessed everyday for the rest of her life.

3

u/Drafting- 45m ago

My gramma told me she was holding a knife over her first husband after years of him beating her and the kids. Then at the last moment she broke the window in the bedroom and car instead. She left him not long after and lived with her sister and all her kids and husband. Then met her second husband, he was controlling but he didn’t abuse her. Weirdly her new husband and her would hang out with her ex husband and his new wife. She says god helped her forgive him but I don’t know, feels more like a generation that never talked about trauma.

I wrote something, something i think is pretty logical, but i know that people like to paint logical things as bad views or hate filled comments on reddit, so i didn‘t.

I hope the mother and daughter both are able to find professional help for their life-long trauma that man inflicted them with.(is that english?) no human should go through that and i cannot imagine the pain for either of them, especially not the mother that has to live with a sense of guilt for being the person that brought the rapist into her life, it was not her fault but that mans.

8

u/LawfulAwfulOffal 3h ago

I don’t know the Brazilian system, but in the US, this is ‘jury nullification.’ Where the jury decides that a crime, while maybe technically committed, should not receive the usual punishment. This seems like the exact sort of situation where that makes sense.

12

u/a3a4b5 1h ago

I'm brazilian

In these cases, I don't have a clue of what happens because I haven't studied law.

Hope I helped!

1

u/buffhottie69er 2h ago

A judge can do the same, if I'm not mistaken.

2

u/xgabipandax 16m ago

In Brazil it's up to the jury to determine if the person is being convicted or not in murder cases.

9

u/Butta_Brown 3h ago

This shouldve never made it to court. The moment the inital police investigation was over, she should've been allowed to go free. AND (being honest) SHE CONFESSED! they should've honored her.

Kids/children should be protected NEVER violated.

What's with all the cops surrounding her if she's being acquitted? Nobody's ever started a fight while that's happening.

-2

u/ChainedBack 4h ago

Is there evidence of an assault? It's pretty disturbing people here will justify drugging someone and murdering them so long as their significant other claims child molestation. I wonder what people here would think if a man did that to a woman he accused of such a thing.

17

u/panicnarwhal 4h ago

well, she caught him on top of her child with his pants down and his hand covering her mouth to muffle her screams. there were also alarming, explicit texts that he had sent to the child, suggesting this wasn’t the first time he had assaulted her (or attempted to)

i went through something similar as a child (without the stabbing of the perp), and i had forensic interviews and also an exam. i am sure the child went through similar

4

u/RogueBromeliad 3h ago

Don't forget that they also found evidence on the daughter's phone that the stepfather was sending her inappropriate messages of the sexual nature, that further reinforces her case.

10

u/dogheropartime 4h ago

yes, there is

6

u/RogueBromeliad 3h ago

Yes there is. And also there's further digital evidence that the stepfather had been sexually harassing the girl with messages.

Also in the woman's testimony she's been consistent about the events, which means she isn't lying.

7

u/Successful-Party-367 4h ago

Maybe her daughter testified against him too?

8

u/miss_elmarie 4h ago

It’s people like you that keep girls in an unprotected predatory state.

1

u/ChainedBack 2h ago

Because I question how a woman has access to such mind altering drugs and spikes someone's drink to kill them? If you don't question a man's intention if he spiked a woman's drink then killed her, then yikes.

I'm genuinely curious, would you immediately take the man's word in this case?

2

u/Marsupialize 3h ago

Do you just not have access to google?

7

u/dogheropartime 3h ago

Unfortunately, this is yet another teenager who has fallen for the rhetoric of the far-right, which constantly casts doubt on women’s accounts by suggesting they are making false accusations.

These young people end up being bombarded by this narrative, and whenever a woman reports abuse (even in cases like these) it has become common to see teenagers make the kind of comment he made.

It’s very sad, but it is the reality for young people today.

3

u/Marsupialize 3h ago

It’s just so weird when they post ‘I wonder’ shit like this that would be answered in literally .5 seconds of googling as if there’s just no way to know, I would feel stupid as fuck publicly making these statements and insinuations without a second of research or effort

1

u/dogheropartime 3h ago

he knows

but he wants to be on their side. Bc community matters and sadly right wing community grew a lot on youngsters

1

u/ChainedBack 1h ago

So do you think everyone who commented or upvoted Google this story first? So it's okay to condemn someone to death based on the word of one person without doing research but it is not okay for me to ask a question before doing research. This is what you are saying correct?

2

u/ChainedBack 2h ago

Why would I Google this?

1

u/ar9ent0 3h ago

Si hay pruebas perfecto, ahora si es solo un testimonio......

1

u/RogueBromeliad 3h ago

Now I'll get downvoted to hell, saying it's not excluded beyond reasonable doubt...

Persons killing and here mainstream cultural consensus about morality "saying" that it was not wrong to kill in that context, and these persons killing are also having a mental disposition alike a murderous sociopath. And it's coincidentally so that this questionable character killed and it happens to be in current cultural mainstream consensus that killing was not wrong in this context. That probably happend more than once.

Person that also comes with a superlow threshhold for extreme violence or extreme brutal punishment for trivial mistakes too/aswell. Also this person is superuninterested in adhering to your mainstream ideas of cultural moral consensus.

Good mothers protect and care for their children.

Were you having a stroke when you wrote this?

-6

u/Massive-Albatross823 4h ago

Well, are you insulting a person who is in severe pain and lifethreatening situation (due to stroke)? 🤔

3

u/FlamingoStink17 4h ago

I called the paramedics, they’ll be there in ~54 minutes (they’re on their lunch break right now)

-6

u/Massive-Albatross823 3h ago

That's a horrible misuse of 911.

Someone with a real stroke probably died because of you doing that.

All because of your ego.

5

u/FlamingoStink17 3h ago

Wait… so you DON’T need medical help?

That’s a horrible misuse of 911.

Someone with a real stroke probably died because of you doing that.

All because of your ego.

0

u/Massive-Albatross823 3h ago

Watch out for this person, because if you ask them a question to engage them in a thinking activity they will claim you made a statement and misuse 911. Alternatively if someone is having a stroke, they will lie they called 911 and go about their day.

7

u/FlamingoStink17 3h ago

Tell you what, if you can point out where you asked me anything, what statement I claimed you made, or even just where I said I called 911, I’ll go stroke myself.

Real talk (because I’m just having fun - a thinking activity in its own right), I hope you’re healthy and happy on this beautiful day. Didn’t mean to ruffle your feathers lil bud. Much love.

Ok back to jokes… dork.

Back to serious: sorry about that last line.

3

u/Blue4life90 3h ago

Absolutely none of what you said makes any sense. Not sure what your perspective is exactly but the downvotes are from being inarticulate in conveying your thought process.

7

u/panicnarwhal 4h ago

sorry, but are you saying someone sexually assaulting your child (or any child) is a “super low threshold”, and also calling it a “trivial mistake”?

wtf?

-1

3

u/dogheropartime 3h ago

Maybe you didn’t write what you actually meant to say. Could you explain it in a different way?

Because what the previous person understood is the same thing that I understood as well.

3

u/RogueBromeliad 3h ago

She did it to protect her daughter, and she caught the guy violently trying to rape her daughter. Also the title is wrong, she didn't spike his drink, the guy was drunk, and she acted as she saw what happened.

In all her interrogation she was consistent about the events and that means she wasn't lying about what she saw and what happened. Also there were digital messages from the stepfather to the daughter which corroborate with what was happening.

1

u/Massive-Albatross823 2h ago edited 1h ago

She is not blameworthy at all, I agree. Good mothers care about their children. Furthermore, I still believe that evil (read; malicious or deliberately cruel) people sometimes get mistaken for people doing things for the right reasons, such as doing things because of it’s the right thing to do.

3

u/DiscussionSharp1407 4h ago

What would be your bar to apply lethal force against someone?

Having your child repeatedly raped isn't in the ballpark?

I think you're closer to the 'sociopath' spectrum than the brave woman in the video...

3

u/MainPerformance1390 2h ago

Except that's not what happened here.

-2

u/RepresentativeAspect 3h ago

Or - she murdered her boyfriend and came up with a good story.

Or - she could have called the police after drugging him.

2

u/RogueBromeliad 2h ago

No. Firstly the post title is wrong. She didn't drug him, he was drunk, and it wasn't premeditated. She found him on top of her screaming 11 yo daughter, with his pants down, dragged him into the living room away from her daughter and then stabbed him.

Secondly, there's digital evidence that the stepfather was digitally harassing the girl, the police found messages on the daughter's phone prior to the event.

Thirdly, there was testimony of another woman that helped her get the body outside of the house and both their testimonies were consistent throughout the interrogations which indicates they weren't lying.

Fourth, she admitted to killing him straight away, when the police arrived, which isn't the case of someone trying to make shit up.
