Executive Branch (Trump)
Zoran Mamdani has released video stating that after a review of legal avenues, New York City does ot have the legal authority to arrest Benjamin Netanyahu in accordance with the ICC's warrant if he comes to NYC. He calls on the federal government to join the ICC and execute the warrant.

United States of America are not party to the International Criminal Court and as such, they don't fall under it's jurisdiction. The only one's who can arrest anyone with a criminal warrant issued by the ICC are federal law enforcement directed by the executive (which would, de facto, adhere to the ICC this way).
States cannot adhere to international treaties like this.
So I've been wondering and hoping someone could explain this to me as I'm pretty ignorant to American laws. But did this mayor actually get voted in expressing that he would arrest the leader of Israel? It seems like a really far fetched idea as where I am mayor's help bring forward bylaws, that's it. They can't enforce anything or sway any policing unit to do so. And did people really believe him on the platform that he was going to single handedly deal with an international crisis as a mayor?
I hate my brain for this, but the first thing I imagined is being trapped in that little room with Trump’s stench, no way to get away from it. That, plus having to deal with his nonstop moronic yammering has gotta be pretty close to actual, literal hell.
US would invade The Hague they have a plan for that it sucks but when you have the biggest military on earth theres pretty much jack shit anyone can do to police you that won’t lead to tens of thousands of your people dead.
If the next president is a Democrat they may make a deal with the ICC that they can arrest him as soon as he leaves the US and the US will make a big fuss publicly but not actually do anything to recover him
How many laws have been violated/ignored/not enforced under the orange turd's administration? Pretty sure the next sitting president can make an exception.
And Trump just LIKES him. He says nice things that gives Donny happy feels.
Trump wants the world to be controlled by a few powerful bosses who he can call on the phone and get gifts from.
Things like a large group of people mourning a religious leader because of their shared beliefs and ideals TERRIFIES him. Who do you call on the phone? Who will bring the gifts? It’s all too annoyingly confusing for him.
Trump is easily played because he is a simpleton, that's why people like Yahoo and Putin can get everything they want out of the idiot because he respects them for all the wrong reasons.
Trump considers himself a kleptocrat and like all kleptocrats like mingling with eachother. Make no mistake, Trump, Xi Jinping, Putin, Netanyahu are all carved from the same wood, some may take longer to get where they are, but they are all best friends for one reason or another. They all have in common one thing, they hate free democracies and gladly abuse their powers to stay in power.
There's no credible source for Netanyahu being godfather to Jared's kids (or to Jared himself for that matter). "Godfather" isn't even a Jewish tradition, and both families are Jewish.
What's real is a decades-long friendship between Netanyahu and Jared's father, Charles Kushner.
I keep seeing the "Ben has the Epstein videos", which would make a lot of sense considering how strangely loyal Trump is to him... but do we have proof of that somehow?
Yeah that's one of the most uncomfortable parts of this Israel bullshit.... You'll say something negative about Israel, someone will go "fuck yeah, they deserve it!", but then you realize they're not talking about Israel the country, they're literally just talking about Jews in general.
And yeah I'm not willing to party up with a bunch of anti-semites just because there's a slight overlap in the Venn diagram.
Ghislaine Maxwell's father was Robert Maxwell, who was a suspected Mossad agent. Many people believe that Epstein's island was - at least in part - a Mossad honeypot operation. If that is the case, then there is no chance that Netanyahu doesn't have the Epstein videos.
They certainly will not as long as any other option exists but that's been true of every other empire also and they all fell eventually and most faced consequences as a result. Trump will never be held accountable, he's too old and fat to live to see it. His minions may well eventually though.
That is not just Trump, I am afraid. The entire American politcal establishment, due to the philosphy of American Exceptionalism, does not recognize the ICC.
Trump will never end up under the ICC, because no American politician will endorse it, no matter the political spectrum, because if that happens, it sets a precedent that American citizens, either private individuals or public officials, can be subjected to a tribnual that is not biased nor partial to US external interests. I mean, ffs, there is a law that authorizes the Congress to invade the fucking Hague if any American citizen ends up in the tribunal (the Hague Invasion Act, Ilhan Omar tried to repeal it in 2022 but the bill died).
Simply put, Americans do not want to be subjected to any international tribune that they cannot influence, bully or threathen their way out of, no matter who it is, that is why they steadfastly refused to ratify the Rome Statue (Clinton did sign it, Bush withdrew it).
Jesus Hebrew Christ, y’all, neither the US nor Israel are signatories to the ICC. The ICC does not have jurisdiction in either country, or over either country’s citizens.
You have all been told to expect Netanyahu’s arrest. That’s a load of bullshit.
Well, the IMT didn't have any authority to prosecute German nationals either, until it did.
All legal authority fundamentally stems from the ability to leverage force to effect that legal framework and there may well come a time when America is no longer capable of sheltering their political powers. It won't be soon but the present de facto immunity is unlikely to last perpetually.
When you go to a different nation, only the laws of that nation are applicable. America will not prosecute you if you broke the law of your home country. If there is an extradition treaty, they may send you back. But that's only if a treaty like that exists.
The ICC will prosecute anyone regardless of wether their home country recognizes the ICC or not (hence why the ICC has issued warrants for Netanyahu and Putin). ICC member states are then required to arrest those who the ICC has issued warrants for.
The more relevant thing here is the US does not recognize the authority of the ICC and so has no obligation to arrest Netanyahu under international law.
unfortunately, it kinda makes sense that the US and more specifically NYC wouldn't carry out any arrests because the city as the host of the United Nations, is meant to be neutral ground. otherwise no one would show up for any sort of negotiations
What if my grandmother had wheels? Am I missing something here? It seems like the Head of State of a UN Member Nation attending the General Assembly at the HQ in NYC might be granted something like a "hall pass," no? Something, something parking tickets?
Yeah, it would have to apply to Putin as well as he also has an ICC warrant out. And would prevent the UN from functioning properly. If New York didn't allow leaders to attend with immunity they'd have to move their meetings somewhere else.
New York would basically immediately stop being the host of the UN. Half the world would immediately pull out its people for fear of arrest. Geneva would probably replace it.
The US isn’t a signatory to the ICC. Neither is Israel. The ICC can complain all they want, they don’t have the jurisdiction to arrest anyone on US soil, least of all an Israeli.
Implying that normal liberal democrats don't follow the law is a big cultural loss. Democrats in general are good and have to struggle to do good things.
My point, to spell it out, is that it’s a good thing a Democrat got legit coverage and airtime on a hot button issue, an “extreme” Democrat at that, and ultimately the obvious law prevailed. It’s a clear, night and day contrast. During an election run up no less. Two wins for the moment.
While I appreciate following the law … to have just arrested him and then fight in court like the Trump DoJ does for ICE would have been poetic. Maybe just send him to the ICC with a “whoopsies” afterwards like when we’ve been deporting people without Due Process.
I'm sure it would be cathartic for those who hate Bibi.
Honestly I don't think there is a single stupider move Bibi's detractors could possibly make.
The man is unpopular, about to be voted out of office, as a disliked politician with a poor recent track record.
If there was one thing that could balloon support at home, a legally dubious arrest by an avant anti Israeli politician in the US who well knew he had no authority to do it, but wanted to throw red meat to an anti Israel base?
You do not want pictures of Bibi in handcuffs railing to the press about how the law has been abused to attack him as he is let go by the Feds, an open and shut case of legal abuse... When one of his weakest points is the legal cases against him. It's about the only thing I can picture saving Bibi's career right now and creating a rally around the flag effect for his party.
How on Earth do you suppose Mamdani could exfiltrate Netanyahu to the ICC with whatever NYPD he has, in such a way that the US Military (that Trump controls) couldn't just fucking curb stomp and get him back?
You think Mamdani is going to be able to get Netanyahu on a trip to whatever ICC headquarters you're taking him, without a dozen fighter jets and helicopters and tanks tracking your every move from the second you try? You ain't getting out of US airspace
It would have lead to Mamdani probably getting arrested by the government, stripped of his role (even if Trump doesn't have the authority to do that he will act like he does), set off massive investigations into Mamdanis inner circle and administration for years, lead to a growing movement that will call to deport him because he "doesn't follow US law and is an enemy of America"
People always talk (very negatively...which worries me) about how someone in prison can still be an elected official. However, that's actually necessary for a democracy to work. Most politicians convicted of crimes step down from their posts because in most cases it's the right thing to do, but it's not illegal to be in prison and an elected official. It's actually, like I said, necessary for a democracy to work.
If someone could put you in prison and invalidate your election or candidacy, then we do not live in any form of democracy, and the judiciary and executive branches could not be co-equal.
That's what's pissed me off so fucking much about Trump. He could have been convicted and sent to prison, and could still be president.
It is necessary that any natural born US Citizen can become president. That's the entire point. To see him completely escape any consequences is what's so absolutely disgusting. Dude should at the very least be president from the fuckin' klink if there was any justice in this world.
That would not be a fighting it in court kind of crisis, that would be Trump sending the national guard to kill him kind of crisis. Plus there is a zero percent chance the NYPD would agree to enforce the warrant if he did have the authority.
Still good for him for even asserting this in the first place. He is basically the only politician in America talking about what actually needs to be done.
America isn’t part of the ICC or even recognize its authority. It wouldn’t go too well in court for him—they’d probably give him life for treason. I’d assume it would technically be considered the same as being a spy or traitor.
Honestly, I wish someone with way more experience in international law could explain what would actually happen if someone tried to ignore U.S. law to execute an ICC warrant.
For one, they'd be forced to release him, and the ICC wouldn't be able to do anything at that time. Second, Trump would definitely take major action against Mamdani and NY, probably do whatever he could to remove him and he'd have his fanatics backing him up
There wouldn't be a "fight in court" over it, there would have been massive federal raids, arrests, martial law and the national guard, and probably some treason charges.
god love him for even researching if he could. the world knows that israel is commiting genocide and hopefully they know that some of us in the states stand with gaza.
it is important that the mayor of the largest city in the united states acknowledges that israel is committing a genocide and netanyahu is a war criminal.
That’s absolutely not true “if I purposely shoot someone with the intent to kill them not in self defense, is it murder?” Can be answered in about 1 second
This is the kind of “4D chess” politics that the right espouses Trump is brilliant at. Regardless of legal authority, more people are becoming aware of the truth
You think a bunch of cops would spook him? He already knows he's invincible on Trump's watch. If anything, it would make Mamdani look weak for trying to make a show of force, while Netanyahu just strolls right by them and does whatever the fuck he wants. Netanyahu could execute a child on camera in Times Square and Trump would still suck his dick. That's just the world we live in right now.
I know it's a dead horse mentioning him, but if the mayor of my city personally ordered the arrest of Hitler if he came to my city, I'd vote for them even if they were a yellow dog.
The White House is going to be so pissed a younger hotter non-white politician of a flagship American city is pulling focus. Lol. They’ll probably start domestic drone strikes by the weekend.
Mamdani himself absolutely knew this already too. He's making a political show of it so he can make these viral videos to make people aware of the ICC and America's relationship to it. Also to make the public aware that netanyahu is a war criminal by the ICC's standards and that the American government is complicit in his protection.
This is straight up a lesson he's learned from Trump and the Republicans. Trump has used his access to the media to move public opinion so far to the right just because the news has to cover what the president says; he can basically inject whatever insane talking point as the new normal, with very few exceptions it seems. Mamdani is doing the exact same thing, and since he's the new "face of the Democratic party," it's kinda working hopefully please
I’m a legal assistant with a bachelor’s in IR and I know that. If you work in legal and have even a passing interest in IR, you know that we’re not a signatory and not bound by the ICC, he has head of state immunity, and he’s protected by federal law, thereby preempting any state’s authority for law enforcement action. As much as I’d like to see him arrested, it’s just not happening by US domestic authorities. The one caveat I’ll give is that the ICC doesn’t care how their criminals appear. If he were to be spirited away and end up before The Hague, they’ll try him. I sincerely wish anyone that decides to give that a try the best of luck, as they’ll be up against a Secret Service detail. Fuck Bibi; free Palestine.
It takes one course covering the basics of the Constitution to understand that.
Article I and II are quite clear about who handles foreign policy.
These threads are really strange. They have been popping up on an array of subs and its always the same stuff about the ICC or States Rights and how Bibi can be arrested by a Mayor of a city...
Its quite alarming if everyone truly wants to just toss the rule of law away.
It takes one course covering the basics of the Constitution to understand that.
I bet most people learned this in high school but since they've never had to use the knowledge they just never retained it.
It's easy to say "Everyone should know this" when you work around certain topics for a living, your base of knowledge is higher and warps your perception of what general knowledge is.
Yeah, I genuinely don't how anyone doesn't find this shit embarrassing. He obviously had zero power to do this. He's not an idiot. He knew it was never going to happen. Charitably he was making a statement. But reading the comments here, it's obvious he riled up some less than critical thinkers
Yeah but he mentioned it once during his campaign so he had to put on this dog and pony show pretending to see if he could do a thing everyone knew he couldnt do.
The federal government easily has the power to overpower NYC in this scenario and it could lead to Trump kicking Mamdani out of power for not following the law. Additionally, the NYPD (as well as the police in general) are mostly conservative and unlikely to be very anti-Zionist, so even attempting this could risk the police straight up refusing orders and going against Mamdani.
There just isn't a good way to do this that doesn't risk it massively backfiring. Mamdani doesn't need to fix every problem with the U.S. - he should focus on fixing the problems of New Yorkers as he was elected to do.
Because the city of New York has no legal authority to arrest him (even if the US were a signatory to the ICC treaty, it wouldn't be in the city's jurisdiction), and does not have the raw power to get away with doing things they don't have any legal authority to do.
