Considering it's Elon and his tech billionaire pals who put Trump and GOP into power, Elon is going nowhere. They are destroying the USA for a reason.
The richest men on earth, tech billionaires (ie Musk, Thiel) goal is to destroy this current global system of things and install boundary-less techno authoritarian states with mass surveillance run by corporations around the world. They don’t want democracy. This is what concentration of wealth looks like: a worldwide coup. Tech billionaires are the enemy of humankind.
Hear it from their own mouths.
https://theplotagainstamerica.com/
They use tactics of fear and anger to drum up votes and support. It's a very common practice of populism, fascism and dictators. This is how Trump got voted in.
They learned from Edward Bernays, psychologist to the dictators:

It is kinda wild to me that people can apparently think citizenship should automatically go to someone born in another country just because one of their parents was a US citizen who lived in the US like a decade prior, while simultaneously thinking citizenship shouldn't go to someone born in the US if their parents are still going through the immigration process while living on American soil.

I was afraid this was going to be their next step. I’d love to hear what the legal experts think as far as how to stop the administration from doing it.
1.5k
u/geekmasterflash 2d ago
She'll have some of the best lawyers money can buy, but given how much authority the executive branch holds over immigration enforcement, I wouldn't dismiss the threat.
The important distinction is that denaturalization has to go through federal court, not an immigration judge. The DOJ would first have to establish legal grounds to revoke her citizenship, which carries a very high burden of proof.
If they somehow succeeded, removal proceedings would generally come afterward, before immigration judges who are part of the DOJ rather than the independent federal judiciary.
So the administration can't simply revoke her citizenship by decree. But it can use its considerable investigative and prosecutorial powers to pursue her, and the legal process itself can become a means of political intimidation, even if the case ultimately fails.

u/oxxcccxxo 2d ago

170
u/NovarKalar 2d ago
Slight correction: If they somehow succeeded then she could presumably immediately apply for citizenship again, as she easily meets all the requirements. Being denaturalized would simply return her immigration status back to what it was before, which technically would leave her as a legal permanent resident with over 5 years of continuous residence.
This story is particularly stupid, because she had already been here for 5 years before she became a citizen, so lying about her age wouldn't have even been necessary.
→ More replies (3)52
u/-Gramsci- 2d ago
Ah. This is facts I didn’t know.
So IF it is true her father lied about her age (so she could accompany him as a minor)..
That was merely a visa?
Then she naturalized, on her own volition, as an adult some years later?
If this is the case… then yeah. I can’t see why her father lying about her age would have changed her naturalization application.
Could it?
115
u/NovarKalar 2d ago
Her father and her came here as refugees when she was 12 (in 1995) and both gained Legal Permanent Resident status. They both became citizens 5 years later when she was 17 (in 2000), as is normal. Whether she was 17 or 18 really only matters for the citizenship paperwork. Either way she would've been just as eligible for citizenship as her father was, even if she *had* been 18, since she had been here for just as long.
So this whole "investigation" thing is incredibly stupid and ridiculous.

170
u/geekmasterflash 2d ago
Not zero, but forcibly detaining and deporting a sitting member of Congress without due process would escalate into a constitutional crisis very quickly.
You'd be looking at emergency injunctions, expedited appeals, potentially emergency intervention by the Supreme Court, and an extraordinary confrontation between the executive and judicial branches. There would also be the small matter of effectively disenfranchising her constituents.
That said, never forget TACO. Trump has a habit of making extraordinary threats and then backing down when confronted with the consequences. He's also remarkably inconsistent about which threats he actually follows through on.
The danger isn't necessarily that he'll carry out every threat. It's that eventually he'll follow through on one that the constitutional system cannot absorb without a serious crisis.

There is no statute of limitations for civil denaturalization.
While both paths result in revocation of naturalization, a civil revocation may occur at any point after an individual naturalizes as there is no statute of limitations.[23] There is a 10-year statute of limitations for criminal denaturalization.[24] However, criminal denaturalization cases that have passed the 10-year statute of limitations may be referred for civil denaturalization.

They need their base filled with equal parts fear and rage and ONLY discussing Muslims and deportation. Fear is their only hope
They need their base to stop thinking about what's happening to their lives and families. They need them to vote against themselves, out of those chaotic feelings, and unite behind hate.

Absolute bigoted madness. She hasn't done a damn thing other than be a female Muslim Congressional Representative from the opposing party. Trump and his spineless sycophants manufactured all these absurd stories about her, talking about she married her own brother, which is manifestly untrue.
Now they're peddling bullshit about financial impropriety, and ginning up stories questioning her citizenship. This is among the most hateful, bigoted, defamation campaign, and even tho they themselves invented these stories for the intentional purpose of dehumanizing her, and casting her as a terrorist who snuck into the country in order to infiltrate Congress, and pass state secrets back to her handlers in Kabul.
There is no basis whatsoever to open this farce of an "investigation", let alone attempt to strip her of the citizenship and home she built here, and deport her to a 3rd world country that she's never been to. That is no joke what they're planning on doing to her. She's a better American than any of those hateful MAGAts and lickspittles who seem to relish the thought of making her a scapegoat for all the delusional and hateful beliefs they have about everyone who is isn't a white dumbshit Christian of the specific brand of Christianity they follow.
I could spend another hour dismantling all their embarrassing, humiliating rhetoric that illustrates just how bigoted and dumb they are.
Ilhan Omar pursued her American dream, and she made it come true. Her story represents the aspirational ideals and values we strive to acheive, and the promise of success if one follows the rules, comes here the right way, and commits themselves to patriotism and achievement. I have no doubt Trump and his followers would perform poorly on the mandatory citizenship exam that she aced to secure her place as a true-blue American.
But they're going to lecture us and criticize Omar over her superior intellect and love of her country. She's remaining dignified throughout this historic mud slinging the Republicans are subjecting he to. This is bullying on an epic level, and they need to be remembered be forever remembered for their role in this disgraceful witch-hunt.

This is so true, there's no way Trump is passing a basic citizenship test and I bet most Republican voters couldn't either.

Exactly. When it’s proven that she’s here legally all they’re left with is a smear campaign but they will still want to use that for talking points. The damage is done. This is Obama’s birth certificate all over again.

I will laugh in the face of any Republican who wants to argue about their fealty to law and order at this point. They're an anti-American party of literal morons.

Can they do Elon Musk next. He started his first business on a student visa when not enrolled in a college. This is not in compliance with being able to work in America as a foreign national.

As always, this is just stupid performative charades so their rabid dog base starts salivating. She can stall this in court for so long, old man Trump will be dead by the time this is over.

Every GOP candidate for Congress should be asked one simple question at every debate and campaign event:
"Will you commit to voting in favor of every impeachment of Donald Trump if you are elected to Congress?"
Any answer other than an unqualified "YES" should be immediately disqualifying.
By the way, every Democrat candidate should be asked the same question with the same consequences.

The Dems need 70% in both houses to have a veto proof majority and be able to actually impeach and none of this voting for Repubs nonsense
Get out to vote if you want him gone

Not only citizenship, citizenship of an elected representative. If they do this, what's stopping them from doing it to literally every democrat in Congress?

And will there be anything she can do to stop it (without it turning into a massive street battle).
Dark time ahead.

https://www.motherjones.com/politics/2016/08/donald-trump-model-management-illegal-immigration/
But the mogul’s New York modeling agency, Trump Model Management, has profited from using foreign models who came to the United States on tourist visas that did not permit them to work here, according to three former Trump models, all noncitizens, who shared their stories with Mother Jones. Financial and immigration records included in a recent lawsuit filed by a fourth former Trump model show that she, too, worked for Trump’s agency in the United States without a proper visa. [Note their illegal status was a means for Trump & Co. to coerce vulnerable non-native speaking girls to “party” with wealthy men.]

The DoJ already found a judge to rubber-stamp the warrant, and they will find a judge who will rule that the investigation may continue. Eventually, they will get the result they want, because who will stop them? Who has standing to stop them besides the people they’re persecuting?

Omar should use this to her advantage. Exploit every aspect of it to show herself as being victimized. Become a martyr. Let this become a huge story that will never go away and make it work against trump and maga.
Look at it as an opportunity. Any future dem should also ensure her citizenship if the trump regime somehow deports her.
