Ditto. But not enforcing is not equal to rule changes.

It's kind of like weed: the federal law is still there but it isn't enforced so people behave like it doesn't exist.

The difference is that if the ATF decides to return to enforcing the NFA for whatever reason, the consequences are way more severe than being caught with weed. The ATF can return to enforcing the NFA just as easily as they stopped the other day.

And the reversal doesn't require an admin change either. I mean.. the latest press secretary. Lasted... five days?

You were 1000% correct and what you’re saying. There is one small silver lining in all of this that I haven’t heard anybody else mentioned. Constitutionally the NFA is on very shaky Ground and arguably is unconstitutional. Doubly true for the controlled substances act. Historically, power is a lot easier to give away than it is to get back. I think some, possibly many states, will fight the feds if they ever about-face with marijuana or suppressors. This is a good thing for two reasons. The first is it seems like the states get priority when going to the Supreme Court. The second is they have a whole hell of a lot more money than small groups like GOA.

Yup! I would say, definitely take advantage of the ease of acquisition. But make sure you submit the paperwork anyway, as the atf is still accepting it, that way when/if they decided to enforce this again, you aren't in possession of federal felony level contraband.

u/V0RT3XXX 1d ago

Can you submit F4 after you did a 4473 and took the can home?

4

u/FourOhVicryl 1d ago

Only if there is a change in ATF leadership and they declare an “amnesty” prior to (re) enforcing the existing law. From the FAQ on the page:   “Please note that once an item is removed, it cannot be re-registered unless the Attorney General declares an amnesty.“

2

u/FourOhVicryl 1d ago

Also from the same page: “ Federal law does not generally permit subsequent registration of unregistered NFA items nor are there provisions that would automatically grandfather unregistered NFA firearms.    There are narrow exceptions that exist at the Attorney General’s discretion.  The NFA permits the Attorney General to hold an amnesty for up to 90 days to facilitate registration of unregistered items.  The Internal Revenue Code also has provisions authorizing certain forbearances of taxing provisions. The Attorney General is not required, however, to hold an amnesty or to provide forbearance.  That decision would be made by the Attorney General at the time the injunction is dissolved.“

I'm really curious how that works during this time period though. Like they aren't enforcing the rule. So what if I get one today, and don't file a Form 4, but then in 2 weeks or a month (while they still aren't enforcing the rule), would I be able to submit a form 4 voluntarily? I don't think their letter gave guidance on that.

2

u/FourOhVicryl 1d ago

The form 4 originates with the manufacturer,  not the consumer. In an “amnesty” situation, you’d have the option to submit, but not currently. If you have a 4473, you are able to use it in a “free” state, but as far as picking up the form 4, you may be SOL. Not really a huge deal, just limits your ability to carry or sell it in states with restrictions currently. Warranty work on a 4473 is beyond my understanding, it may or may not be an issue.

I always figured someone could just submit a Form 1 for manufacture of an NFA item, as how firearms can become machineguns, rifles can become short barreled rifles, etc.

Thus, your 4473 Suppressor could become an NFA suppressor? Does that logic actually track?

Or would they not honor that? It seems like it could be a functional way into standard registration.

2

u/FourOhVicryl 1d ago

You could, but you’d likely need to engrave your own part number and serial number on it, and somehow remove the existing ones. If it’s got the old info on it, you have “contraband”. I’ve never filled out a form 1 and I don’t know if it requires you to assert that you manufactured the device yourself. It certainly won’t work if you ever have to send it in for warranty work, tho. If you want something completely off the record tho, Fram and Purolator make extremely inexpensive and disposable accessories.

u/FoxyWolf27 1d ago

Not actually sure on that, but I assume you can. Probably something to reach out to the location you purchased from about and see if that is something they can do.

3

u/aaronhayes26 1d ago

Not enforcing for 2 years will likely force a rule change since the next admin is likely not going to risk the political fallout of threatening to arrest thousands of legal gun owners.

4

u/GrumpMaster- 1d ago

I agree with you, especially for suppressors. There are no solid arguments against suppressors making any gun more lethal and actually makes them safer to be near.

SBR’s though, I could see them playing games with them again cause it’s an easier change to slap a brace back on.

The more suppressors we buy in the next two years, will only help this change to be solidified. I’m doing my part, I can tell you that!

1

u/gotmonkey70 1d ago

I think they would have to do an amnesty thing like they did with pistol braces under Biden.

Thousands? Hundreds of thousands if not millions.

*hundreds of thousands.

My reactions when this story broke:

  1. Yay!

  2. Wait, I live in California so it doesn't matter.

  3. Even if I didn't live in California I'm broke af.

Still, it's a step in the right direction.

7

u/VenomPayments 1d ago

To the best of my knowledge NFA rules have not “changed”

19

u/SgtToadette 1d ago

Why are we trying to minimize the impact of what happened? This is undoubtedly good news for the 2A.

17

u/TheStrayArrow 1d ago edited 1d ago

Laws were not changed. Step in the right direction? I guess but there needs to be actual legislation or judicial review.

6

u/SgtToadette 1d ago

And the way you get the judicial review is by making the toothpaste as difficult as possible to put back into the tube. You need cause, and the more impactful the rule change the better opportunity there is for a successful suit. The more skin we have in the game the better.

My question still remains: Why such a hard on for shitting on this? I grew up in a heavy gun control state and have little patience for naysayers because they never got anything actually done. They just bitch and complain that nothing is ever as good as it could have been.

2

u/eofd77 1d ago

They're mad they had to pay the tax and get their name put on the list and now other people dont have to. Basically "I got fucked so you should too".

Because we’re basically all eating ice cream while mom and dad are at work. They might come home and ask where the ice cream went.

Until I can eat ice cream in front of mom and dad, ehhhhh I’m seeing how this plays out first

2

u/Sugioh 1d ago

For SBRs there's no issue with owning all the parts individually as long as you don't put them together into a SBR configuration until things shake out. With cans though, you definitely create a bit of a hazard by purchasing while things are in limbo. I'd wait on that to be sure.

Not that it helps me much either way as NC requires a Form 4 regardless currently.

2

u/DJDemyan fully automated luxury gay space communism 1d ago

Yeah I figure I just planned to do a perfectly legal AR pistol anyway, I’ll just do that and whack a stock and can on if NFA dies

8

u/Late_Letterhead7872 1d ago

Until the switch gets flipped back on and ¼ of the country are felons overnight. And what party do you think would flip that switch?

7

u/jwalk999 1d ago

Either?

1

u/Late_Letterhead7872 1d ago edited 1d ago

Hopefully the left can win this election, buy some good will from gun owners by destroying the NFA entirely, and push legislation that actually helps without infringing on rights to self defense like secure ownership requirements and a nationwide CCW permit.

8

u/sirbassist83 1d ago

if the left wins this election theyre going to threaten to fuck us on gun rights, make promises about healthcare and industry regulation, and get nothing accomplished that helps or hurts us, the same way theyve been totally ineffectual for the last 20 years.

4

u/Late_Letterhead7872 1d ago

I'd argue that it depends on which faction of the left wins.

2

u/logicWarez 1d ago

Theres two possible factions of the left that could win. The establishment democrats who will push more ineffectual gun bans. Or the progressive and dsa candidates who both don't think citizens should have guns. So in no realistic view of the election does it matter which faction of the left wins.

0

u/Late_Letterhead7872 1d ago

I'm talking about the "Any attempt to disarm the proletariat should be frustrated, by force if necessary" left

Not the terminally online left

0

u/sirbassist83 1d ago

the ones that actually might try to help us wont win or will be neutered. establishment dems still have too much control.

1

u/False_Campaign4682 libertarian socialist 1d ago

Same as the right......

5

u/SgtToadette 1d ago

If the left abolishes the NFA I'll eat all my shoes.

0

u/SgtToadette 1d ago

No. It will 100% be a Democratic administration.

5

u/saints21 1d ago

Lol, yeah the fascist party that's been rattling cages about who should be allowed to own them definitely wouldn't leverage it to their benefit...

1

u/Late_Letterhead7872 1d ago

Problem is they have to hide behind plausible deniability. The left is the only party where half the voter base wants it done.

u/El_Mexicutioner666 socialist 1d ago

Because moderates and Democrats are going to be moderates and Democrats. It's what they do.

Because people are all excited about the right to have something that is not essential when lots of people can't afford a pot to piss in or a window to throw it out of? Nobody needs a suppressor or sbr. They are just fun to play with.

4

u/SgtToadette 1d ago

Then go scream into the void somewhere. A problem with one thing doesn't invalidate progress on another.

If anything, decreasing the barrier for entry to these items will make them more affordable by way of more competition, making the point self defeating anyway.

3

u/Popular-Departure165 1d ago

There's nothing more American than good, old-fashioned debt.

0

u/Chumlee1917 1d ago

It'd be nice to have a suppressor for indoor shooting but like I and you are saying, we don't exactly have a thousand bucks laying around that isn't tied to necessities

9

u/SgtToadette 1d ago

Literally nobody is forcing you to buy one.

-1

u/Hamandcheeseeater fully automated luxury gay space communism 1d ago

I am aware of that but talking of this as it is some big important win that will change everyone's life is a bit of a stretch.

4

u/SgtToadette 1d ago

It is an important win.

3

u/gotmonkey70 1d ago

I hope the free states buy enough to really force the "common" issue for being a protected class of firearms. I wish I could help, but I live in a NFA registration required state. Best we can do is lobby people in power at the state level. Until there a change in my state's laws it's form 1 and form 4 here in Michigan

•

u/CunningLogic 17h ago

Pipe dream, unless the law changes this is a setup. It will be used to silence people in the future and turn traffic tickets into felonies.

•

u/gotmonkey70 17h ago

You miss 100% of the shots you don't take.

•

u/CunningLogic 17h ago

and this is a shot that if you miss, you lose your rights. Not one to be played with imo.

u/pnwal-junction fully automated luxury gay space communism 1d ago

The rules did. not. change.

The policy of enforcement did.

2

u/El_Mexicutioner666 socialist 1d ago

For any serious gun owners and constitutionalists, neither the rules nor the enforcement ever mattered anyway.

2

u/Popular-Departure165 1d ago

I hope people realize that the ATF will go right back to enforcing it if a Democrat takes the White House.

u/El_Mexicutioner666 socialist 1d ago

Then we use our new toys to defend our natural rights. That's what it has always been about.
