I have an OEM copy of Win7, if I upgrade that to win 8.1 will the OEM go away and will I then be able to transfer it onto a new machine?

No. But if it is win 7 it might not be smart enough to notice with a had swap and direct upgrade to Win 10.

Your OEM copy simply means that you have a partition on the drive that will serve as a recovery partition. It'll also have OEM logos and what not. This partition will allow you to reinstall your OS without your disk. If you upgrade to 8.1, you won't be able to use that same recovery partition.

You can make recovery media for Windows 8.1 though. It's usually just a DVD with a copy of the OS you can use to reinstall should you screw it up somehow.
