News ATF Ceases Enforcement of NFA Requirements for SBRs, Short-Barreled Shotguns, AOWs and Suppressors

Friendly reminder to vote, or this can all be reversed. (And you know it will be a priority if and when they do get power again)

u/Lancashire_Toreador 8d ago
The biggest priority is to get as many of these on the market as possible.
Congress folded and changed the NFA requirements instead of trying to enforce the barrel length criteria with just a quarter million M1 carbines.
We have a month of completely unobstructed time to use this letter to flood millions of unregistered NFA items onto the market

u/Sawyer2025 8d ago
Let's make "in common use" great again. The more flood the country, the more difficult to reverse it.

Per Caetano v. Massachusetts Caetano v. Massachusetts (https://supreme.justia.com/cases/federal/us/577/411/)
With 200k stun guns defining common use, we have far exceeded common use at nearly 6 million suppressors.
We just need the courts and or Congress to affirm.

u/Sawyer2025 6d ago
Dropping the transfer tax to $0 and common stores stocking them was a great first step. Now with no NFA process at all, they should be so popular that we have a few hundred million in circulation before the 2028 elections. I expect Trump will veto anything that restricts them from now to the 2028 election.

How does this work in nfa item ban states?....it doesn't does it. :-(
10
u/IVIechworks 8d ago
It doesn't, but if the NFA can be repealed then all the states that say "comply with NFA" immediately lose their ability to oppress people for their firearm choices, and if they scramble to replace them with their own they open themselves up to lawsuits and injunctions that can make their implementation impossible.

u/ammodotcom 7d ago
That's the unfortunate part. Hopefully, this will spark the repeal of the NFA, then states to repeal their laws.
Hopefully.

It could be, under a different President / political administration.
But for now it exists.
By the way as it functions now, Form 4 is voluntary for AOW (and the other things mentioned) but this is an especially big deal for Californians IMHO because it makes it easier for people in California to get to the legal AOW exemption which for most before was practically impossible.
There is no separate California application for the CA § 17710 AOW exemption itself - it is a statutory exemption, still having to deal with assault weapons laws etc - but the pathway to build or buy suddenly is easier.

Common use! Common use! Common use!

u/linktotaiga 8d ago
This right here. If the cats out of the bag in the majority of states and a massive amount of people take advantage of this, it'd be hard to argue that they aren't in "common use for law abiding purposes".
It's a guarantee it'll be tossed if the grabbers take power again, but if gun owners treat every day like black Friday when it comes to these items from now until that happens, its a steeper hill for them to climb when trying to ban them again.

From AWRHawkins
Where it started: Trump ran on being the most pro-2A President ever.
Where it is: Two years into this presidential term and NFA registration for suppressors, SBRs, and SBSs is done, $200 NFA tax is zeroed, pistol brace rule is done, FRTs are legal, DOJ is suing cities, states, and territories, over gun control, DOJ rules ban on handgun sales to 18-20 year-olds is unconstitutional, ban on concealed carry for self-defense in post offices is unconstitutional, and the list goes on. Thank you @realDonaldTrump

If you can't keep your comments to the ridiculously pro-2A news here, then find somewhere else to post political garbage. We're celebrating a victory in here.

I’m interested to see how it’ll shake out in states that allow NFA but require NFA compliance to be legal.

Me too. My life might be about to get a lot more complicated. I’m guessing my FFL will still do it the old way, as long as ATF will approve what’s sent in, which
is certainly an open questionedit: they’ve said they will do.It would be bad for me personally but still funny as shit if they refused to approve form 1s and form 4s for SBRs and suppressors, effectively a “fuck you” to states with more regulation.

No, it's not. They specify this in the guidance. They will continue to offer voluntary registration.

In the letter it specifically says that you can still file for a tax stamp if you choose, so people in states with strict registration requirements will still be able to get NFA items.
It's more murky for states with looser wording like "in compliance with federal law", but if there's no strict state requirement for NFA registration then a simple 4473 would now comply with current federal law for transfers. All up to individual FFLs if they're gonna interpret it that way.

u/goat-head-man 8d ago
Would the stamp have a stated value of $0.00 ?
This would be cool just for collecting.

You’re still subject to state law. If your state bans NFA items, you’re SOL. If your state allows but has to be federally registered, you still have to go through the registration process, which is still open. Now if you live in a state like say Texas, then is all gravy
40
u/thegame2386 8d ago
So....does this mean everything is straight 4473 now?
39
11
u/Sawyer2025 8d ago
Unless you make your own. Then just make your own if there is no state law against it.

For all the people who threw little hissy fits last year when the removal of the $200 tax wasn't good enough for you (and this site was friggin filled with you), let this be a lesson on incremental progress. Small steps are still steps and add up.
No the fight isn't over, but holy hell is this some progress many of us thought impossible a few years ago. Keep pushing.
Remember that your rights were eroded for decades, and really the fight to get them back didn't fully open up until the sunset of the AWB in 2004.
Incrementalism isn't betrayal, it's your friend.

Eh I’m not holding my breath. When the pendulum swings the other way around they’ll reverse all of this progress and add a 2000$ stamp
8
u/VauItDweIler 7d ago
We should never make progress because the next guy may change it, got it. I'm sure you've got a super realistic alternative.

What about the engraving requirement?

What the fuck? This is a big deal, right??
Why is this not a bigger deal???
4
u/Ancient-Bat8274 7d ago
Because states can ignore this and do what they want anyway. A ton of people live in places like California where they’ll ignore this ruling and carry on business as usual
1
u/lunchbox1911 6d ago
Pennsylvania is still going to require us to go through the NFA.
I hate this place.

u/www_nsfw 8d ago
If you already have an NFA item and then you move to another state, does it need to be reported to the ATF?
9
u/Sawyer2025 8d ago
Depends. Silencers never required it. Guidance states form to cross state lines still a law for SBR.
4
u/xchaibard 8d ago
It was a lower when it crossed. I put the short barrel upper on it after I got here.
Prove different.
1
u/r870 8d ago
Yeah, it's still a law. The lawsuit didn't address the interstate transport requirements, and the ATF can't just wave away federal law
1
u/Sawyer2025 7d ago
I guess a braced pistol still has a place in our inventory. If you decide to place a stock on it when you get where you are going, you didn't "take it across state lines", you created it once you got to your destination. Gotta wonder how many ways there will be to get around it, or just clarify the new view of the law.

u/the_spacecowboy555 8d ago
As cool as this is, it’s only enforcement not off the book. As much as I want to go out and spend, I’m more concerned the next admin coming back on this.

Thank you Donald trump, the president who appointed the judge who ruled on this, and leader of the ATF who decided to extend the ruling to all Americans even though they didn't have to. The most pro-gun president in American history (where pro gun is applicable).
All the haters can shut the fuck up forever now.

u/tanstaafl18 6d ago
I'm not going to thank that piece of shit for getting (some) of my constitutionally protected rights back.

u/blueberrysteven 8d ago
So am I covered if I want to throw an 11.5 inch upper on a standard lower now?
1
u/Dregan2D 8d ago
So then for those of that live in states that require those items to be on the NFA to be legal, how does that work?
Do we have to voluntarily request to be added? Is the ATF even doing that? What if we are in a protected class, as well as living here?
There's still a lot left to untangle. And the better get it untangled, the harder it will be to get messed up again when the pendulum swings away again.
1
u/lunchbox1911 6d ago
If you're in Pennsylvania, you still have to register and wait for Daddy government to approve your purchase.
1
u/Ancient-Bat8274 7d ago
That’s cool and all but I won’t blink until states like mine also don’t enforce it either. The blue walls need to be sued.

u/mro2352 7d ago
What does this mean on taking SBR across state lines? Is the requirement from the GCA and as such still in effect?
2
u/mro2352 7d ago
Just looked it up on their site
“The guidance does not supersede state and local laws that restrict NFA firearms. Because many state laws require individuals to register NFA firearms, ATF will continue to process NFA applications that are submitted. The guidance also does not affect the Gun Control Act’s requirement to obtain ATF approval before transporting short-barreled rifles and short-barreled shotguns in interstate commerce. Individuals may obtain that approval by filing a Form 20, whether or not the item is registered under the NFA.”
