Advice & Support Hit-and-run by uninsured driver – advice on MIBI, insurance and recovering costs (Ireland)

• Upvotes

Hi everyone,

I'm hoping someone here has been through a similar situation and might be able to offer some advice.

On Tuesday 13th October, my parked car was hit by another vehicle travelling at considerable speed. The driver also struck other vehicles and a wall before fleeing the scene. Gardaí were involved, and the offending vehicle was recovered, but the driver escaped.

I've since been informed by Gardaí that the offending vehicle was uninsured.

My car is a 2016 Mazda 3, which was in good condition, serviced, NCT'd and running perfectly before the accident. The damage is extensive, particularly around the rear wheel and suspension, and the car is no longer driveable.

I've reported everything to my insurer, RedClick (through First Ireland), and my vehicle has been recovered for assessment. RedClick has advised that they will pursue the Motor Insurers' Bureau of Ireland (MIBI) once they receive the relevant information.

Here's where things get complicated.

I work approximately 60km from home, so having a car is essential for getting to and from work.

I've also recently set up a small food trailer business, which requires a vehicle capable of towing a trailer with a maximum authorised mass of 1,200kg.

After months of preparation, I was finally getting ready to launch when this happened. I've now been left without a suitable towing vehicle, potentially delaying the business and causing further financial losses.

I've arranged a rental car through Enterprise so I can continue getting to work, but this doesn't solve the towing issue. I'm also concerned about how long the insurance process could take and what expenses I'll ultimately be left covering myself.

My questions are:

  1. Has anyone dealt with MIBI following an accident involving an uninsured driver? What was your experience, and how long did the process take?

  2. Can I recover reasonable car hire expenses while my own vehicle is being assessed, repaired or written off?

  3. Given that my damaged vehicle was also used to tow my food trailer, could the cost of hiring a suitable towing vehicle be considered a reasonable expense?

  4. If my car is written off, how is its value determined? Can I challenge the valuation if I feel it doesn't reflect the cost of replacing it with a similar vehicle?

  5. Is there any possibility of recovering financial losses resulting from the delay to launching my business, or would these generally be excluded?

  6. For anyone whose insurer pursued MIBI on their behalf, were you able to recover your out-of-pocket expenses? Is there anything I should be doing now to protect myself financially?

I'm keeping receipts and records of expenses, but I'm unsure what I'll realistically be entitled to recover.

I'm not looking to profit from this situation. I simply want to be put back in the position I was in before someone else's actions left me without a car and disrupted both my employment and a business I've invested considerable time and money into.

It's incredibly frustrating that someone can cause this amount of damage, flee the scene, and leave an innocent person dealing with the financial consequences.

I'd really appreciate hearing from anyone who's dealt with MIBI, Irish motor insurers or a similar situation, particularly regarding hire car expenses and recovering additional losses.

Thanks in advance!

Insurance No insurance collision

Not even going to spit out the whole, “i didn’t know was uninsured” rigmarole. I knew, I was 18 and it was a really stupid decision and I should known better.

Problem is I actually scratched someone’s car, (not while dangerous driving or anything). There was no one in the car at the time & I genuinely didn’t want to evade responsibility so I left a note with my number, so to pay for the damages which I was happy to do so.

The person whose car it was kept saying they’d get a quote and I kept inquiring about it, which they eventually did 3 months after the initial incident. Obviously the owner wanted some peace of mind and I genuinely had full intentions of paying so I left them with my name, address, all my details basically.
Communication broke down because my phone and my SIM tray wasn’t functioning so I wasn’t and receiving messages or calls or anything.

I eventually got it fixed maybe 16 days after I received the quote and the next day I got rung by guards saying the person reported the crash because they thought I was running off on them and they already claimed THEIR insurance (fair enough I would too if I hadn’t heard from me in 16 days) although as I’ve already mentioned, if I wanted to be
like that I wouldn’t have initially left the note.

The guard asked me to present my license and insurance to the Garda station within 10 days, (presumably predating to the time of the incident) they don’t know I don’t have insurance , obviously I’m going to admit that there’s no getting out of it now.

I think about the incident everyday. I’m genuinely remorseful
I’m ready for the ban, potential jail time, fine, points etc

My question is, how do I go about the restitution? and when will the court date likely be if I were to walk into the station now and tell them I had no insurance.

Criminal Law Attending court as a victim, very confused.

I've been summoned to court as a victim. I wasn't sure what to do, so I went exactly a week prior to the court, to do a sort of 'dry run'.

It looks like I'm going to have to stand in a confined open space with the sex offender who assaulted me. I can't do it. I went to court a few days later, and there's no indication or help or reception or anything. I know it's going to be in a specific room, but am I really to just wait in the same room as the defendants?

I feel completely without help or answer and there is absolutely no way I am going to court if that's the case. The letter does say I can be arrested if I do not attend, but I don't care, it's better than being there and just milling around with this fucker.

What can I do? What do I do on the court date?

Crazy Person what can I do if CAMHS isn't helping and Garda keep having to get involved?

So I'm a 17 year old. I'm legally in TUSLA care because my dad ditched me at the mental hospital. My mom's dead since I was 12.

I was left in the mental hospital 5-6 months from January-july. I moved into a residential in July second. I honestly can't tell you how many times the Garda and A&E have been involved since, well over 20 times at this point. I've been restrained many times in and out of the medical hospital. I've been in almost every hospital in Dublin at this point, they hate me.

my behaviours are severe and niche self injury usually through ingestion, I've swallowed so many very harmful things and needed endoscopy, one incident was so niche they got me to sign saying it could be made a medical case study.

I don't want to die. I do the behaviours because of an obsessive compulsive process(as described by an adult pyschatrist without a special diagnosis), I get fixated on the methods of harm until I act or I feel I must 'incapacitate' myself so I can't harm someone(I don't have a violent history).

I was with a CAMHS crisis team, I've been moved back to a non crisis one despite everything. on top of that it's an hour from my residential home. The crisis team was having to come in house because I couldn't attend them without absconding and get hurt. The far out team one said they'd come in person to weeks them expect me to meet them in the middle despite not even being able to attend school or go to a coffee shop down the road without incident.

They only came ones because I had a bad incident during the meeting, Garda and ambulance were called, the CAMHS pyschatrist couldn't give a shit, she didn't even try to confirm I'm medically ok as we waited for the ambulance(medical school who) and just awkwardly left. I had tried getting them to step out the room before things escalated but instead they told me to leave which put me in the position to hurt myself severely.

I'm moderately autistic and I had been having severe meltdowns following the last couple of appointments, they'd get so bad I've made dents in hard walls(proper Irish walls). The residential put their foot down because the appointments were triggering episodes of harm at this point, so I haven't had appointments for over a week now, since the last incident on the 5th.

My GAL is involved and spoke to the courts but I don't know what to really do. the adult hospitals medically review me and rapidly discharge me, and often then I abscond and Garda have to find me after bleeding out.

I want help. I really want help and to live, but everyone (adult A&E, CAMHS) says it's not on them so I don't know who to get help from or how to use court involvement to my advantage in getting help. I'd say I've a fairly good understanding of the Irish systems (I brought a house at 16) but I feel at a dead end.

My gal read a letter I gave her to the courts where I begged for help. The residential has been an incredible advocate and offer me 1:1 supervision but it hasn't been enough. I'm not able to leave the house and I'm always supervised but the incidents continue. Shamefully, Half the Irish Garda know me by name(particularly of the female staff), in fact if a dublin Garda read this they'd likely be able to figure out who I am.

I've been told I could lose my placement if incidents continue. I'm not sure help exists. how can I better advocate for myself legally in Ireland?

thanks for any advice or guidance=/

ETA: [more context I provided in a comment]

I sent this letter to my GAL, she shared it with the courts on CAMHS, on around the 28th;

"To whom it may concern,

I am writing to formally express my concerns about the mental health support and treatment I am currently receiving, and to explain why I feel that my current level of care is not adequately meeting my needs.

I feel that the same care plan from adult services is being repeatedly followed without sufficient adjustment to reflect my current circumstances, presentation, or needs. I understand that adult services are unable to provide treatment to me directly because of my age, but I feel that continued emphasis on safety plans produced by adult services is not an adequate substitute for appropriate CAMHS involvement and treatment.

I am particularly concerned about the lack of timely CAMHS input following incidents. There have been occasions where I have been discharged from hospital and then had to wait several days before receiving input from CAMHS. Given the difficulties I am experiencing, I do not feel that this gap in support is sufficient to meet my needs following a crisis or significant incident.

I also feel that my CAMHS appointments are generally not providing meaningful therapeutic intervention. I would like the opportunity to engage in regular CBT and counselling rather than primarily receiving reviews or risk-management-focused appointments. I have experienced traumatic events in my life, and I feel that regular counselling is important in helping me process these experiences and work towards longer-term improvement.

I also believe that I may currently require inpatient care until my medication regime is stable and my mental health has improved sufficiently for me to manage safely outside of hospital. I understand that inpatient treatment is not something that should be used unnecessarily, but I feel that my current circumstances warrant this being properly considered rather than relying primarily on containment within residential care.

Although I recognise that 1:1 support in a residential setting can be appropriate for maintaining safety, I do not feel that my current support is sufficiently focused on recovery, independence, or improvement. At present, it feels primarily focused on containment. I want my care to work towards helping me become more independent and develop the skills and stability needed to move forward, rather than simply keeping me safe from one day to the next.

Overall, I feel that my needs are being neglected and that the current approach is not adequately addressing the underlying difficulties I am experiencing. I am asking for my care plan to be properly reviewed and for consideration to be given to what treatment would actually support my recovery, rather than continuing the same approach without meaningful adjustment.

I would particularly like the following to be considered:

More timely CAMHS involvement following incidents and hospital discharge.

Regular therapeutic intervention rather than appointments primarily focused on monitoring and risk management.

Access to regular CBT and counselling.

Appropriate trauma-informed therapeutic support.

A review of whether inpatient treatment is currently necessary while my medication is stabilised.

A clear recovery plan focused on independence, improvement, and longer-term stability rather than containment alone.

A proper review of my current care plan in light of my ongoing difficulties and the fact that I do not feel my needs are currently being met.

I am raising these concerns because I want to receive appropriate treatment and make progress. I would appreciate these concerns being taken seriously and discussed with me as part of a review of my current care and treatment.

Yours sincerely,

[my name]"

it's not the perfect letter by any means but it's some written documentation. I sent the GAL this which she sent on the CAMHS after the last incident;

'I wanted to update saying that I'm really struggling with my CAMHS treatment. I really need help but right now appointments are so distressing that I'm consistently having severe meltdowns(with autistic self injurus behaviour, like head banging hard enough to dent the wall) or episodes of self harm following the last 4-5 appointments.

yesterday, The first appointment with the bray team here in [residential name] was too overwhelming and I hurt myself(cut myself rather deep, swallowed some sharp metal and a bunch of soap) and was forced to go to the [Dublin hospital] I got back at 6am today.

I don't feel I can safely travel to the CAMHS appointments or safely partake in one's in the house. I'm really overwhelmed and scared.

I don't feel CAMHS is listening. at the same time they are putting to much pressure on me. They ask for my opinion but ignore it if it's not the answer I want. I askrd them to not use so much small talk because it overwhelms me, they claim they won't but then continue too.

If I'm struggling with words they remove all structure from the appointment and "pause" to give me a break until I'm "ready", except the pause only makes me more distressed and they don't seem to understand that.

I can't safely handle the appointments. I spend days dreading them and it makes it hard to even focus on my studies I'd typically enjoy. I want help but the appointments are providing it and are triggering incidents.

I'm not sure what to do. The CAMHS team keeps saying they are listening but I don't feel they are or when they "are" it's more of an excuse to not start any more specific treatment because they are "waiting" for me. I can't lead, I can hardly follow.

I'm still ending up in adult A&E often and they can't help me saying CAMHS will, but the current CAMHS approach feels detrimental.'

Consumer Law Car Insurance import

Hey folks,

Let's say took out insurance. Japanese import. But just a regular EU-made golf. Didn't declare it on the insurance; they only take first-registered cars from the UK/Ireland

How f'd would I be if i was in an accident with a wild animal on comprehensive insurance? How likely are they to look into the registration of the car. Will claim get rejected for this reason, will insurance get cancelled.Bill will likely be 1-3k

Advice & Support Housing grant application/Retention application ?!

We are trying to get a grant for the derelict property / home refurbishment from county council.

Just received Surveyor report back and it mentions there was no planning permission got for the conservatory or the garage.
Land all around the area is my father’s/no neighbours so I doubt anyone will object. It was abandoned and never lived in over 25 years ago so my father never bothered with doing that.
I’m going to apply for retention and proceed with grant application.

Question is should I get the contractor to keep quotation for the conservatory separate to the rest of house as it may not be included in the works now?

Employment Law What’s the most realistic next step?

My friend has recently been let go from a family business she has worked at for the past 5/6 years, and is struggling with next steps.

The reason she was let go is because one of the members of the family who is a senior member of the team, made an incredibly lewd comment towards her that was overheard by at least 4/5 other people in their office. This man is deemed untouchable and has a history of making multiple women in their workplace uncomfortable by making sexist and sexual comments towards them. Basically the comment he made towards her this time was so gross that it crossed a line enough for others to call him out, and she removed herself from the area. She knew it was going to come back at her negatively.

Two days later, she was brought into an office with HR and was told she was being let go effective immediately and offered 20k compensation for her tenure. She had zero negative marks on her record, no written or verbal warnings, no indication her job performance was not up to the mark. It’s clear that she was preemptively fired to get ahead of the fallout from the pervert’s comments. They know she’s a single mother of 3, that Christmas is coming up and she’s been struggling with the rise in everything so I feel it’s reasonable to think that they thought she would jump at the money and disappear quietly. She has emailed them to confirm in writing that she would like to work things out amicably, and will not be accepting the payout. She has multiple screenshots of messages from colleagues about this particular incident, along with some from a conversation where the pervert admitted what he said to a colleague, brushing it off as a joke.

I think she has a clear case of unfair dismissal, and as her industry is so niche and this company is very powerful and has stakes in some other companies, it’s highly likely she will find it tough to find another role. However, she has a family to take care of and needs income so she’s not sure what the best route is, if she should just cut her losses and take the 20k. For context, 20k is nothing to this company either, they make that amount on a slow week.

She is looking at potential solicitors but doesn’t have a lot of money to burn, what kind of potential fees/resolution timeframes would she be looking at?

Would love for this guy to get held accountable as the entire scenario has hugely upset her but I also know she’s in a tough spot and has to do whatever makes most financial sense. All advice greatly welcome, TIA!

Family Law Court Order Weight

Hi after a long battle we managed to get an interim access order across the line in the last minutes before going in front of the judge. Received said orders and outlines my access and no restrictions.

In the past week my co-parent as started to make demands again and threaten to pull access. They seem unphased by the order and believe they are in a position to pull access as they please.

Anyone in these situations what can be done.

Do I turn up for collection of said access and leave on refusal making record?

Do I contact my solicitor or Garda to log a formal complaint.

Any advice appreciated

got a knee injury i a communal physio class bu the hse and hurnmt my knee as the exercises were way to much for someone that was in bed for 5 years after covid. the day i hurt it i told her. and the next week i told her my knee is swollen and double the size so I will only stay till they usually start the exercises. She the turned around and said today we will do things differently and start with the exercises. I was still motivated by her to participate in them eve if I do 1. But also said no one is forced to do any of the exercises, but as you're being motivated in a group of 10 you feel a bit forced to try especially if your being told the pain is in

your head and you should push through it.

So will I wait for my appointment as I had a scan that confirmed a tear or talk to a solicitor. I tried emailing them 2 times. I filled in a form in june where they asked for a review. I told them everything then emailed Pals and only after a 2nd email to pals requesting my documents from them I got an email that they will review my situation 2 days ago. Still no correspondence.

Criminal Law Taken into consideration convictions help

In Ireland, do offences marked “taken into consideration” (TIC) need to be declared to car insurers?

My court record lists one offence resulting in a conviction and sentence, plus nine other offences explicitly marked “taken into consideration”. I also received a two-year driving disqualification.

If an insurer asks, “Have you any previous motoring convictions?”, do I declare only the offence I was convicted and sentenced for, or must I also disclose the nine TIC offences?

Employment Law Can certified sick days be used against an employee up for promotion?

I have worked in a major retail establishment for over 4 years while working through college. My band of hours on my contract is 12-14hrs but I usually work a lot more especially now that I’ve finished college. I’m currently averaging at about 36hrs.

There are positions open to advance into the next band which would bring my minimum up to 20hrs a week, which is desirable as I was stuck at 12hrs for the first 4-5 months of this year due to no hours being available and I found this very hard to live on after rent was paid.

I have applied for this position but got word that I won’t be considered as my absence rate matched the store average (7%). This is a result on me being off sick for a week a few months back but I had a doctors certificate to excuse me. I had also missed days because they had rostered me to work during college, wouldn’t change the schedule when I pointed out that it clashed with college and couldn’t get a swap. Additionally I was only working 3 4hr shifts a week for months so if I called in sick my average would be hiked up disproportionately to others working full time. There were also a handful of other days that went uncertified, never more than a day at a time.

I have heard that others who have higher rates of absences have completed their interviews and are being considered for the position despite being over the store average. On another note, permanent employees receive a Christmas bonus each year but you have to have received your contract by June 1st to be eligible. As I left work for 5 months to complete a semester abroad, a required part of my studies, I had to come back on a series of temporary contracts until I was awarded my permanent one… 12 days too late to receive a bonus. (These temp contracts were made longer than usual as your fourth contract must be permanent, my last one lasting 6 months) I am just feeling completely hard done by and helpless as I won’t be able to live off of 12hrs a week when January hits with no bonus.

It feels unfair to take certified sick days into account and days where they would not bend to my availability when claiming misconduct. Is this legal? Is there anything I can do to dispute this? I don’t want to leave as I really enjoy my work but I am feeling like I’m being pushed out. What do I do?

Immigration and Citizenship Turkish citizen in Ireland – Stamp 4 application pending for 5 months, facing job loss. Has anyone experienced this?

Hi everyone,
I’m a Turkish citizen living and working in Ireland under the EU-Turkey Association Agreement.
I submitted my application to transition from Stamp 1 to Stamp 4 on 12 May 2026, but I still haven’t received a decision from Immigration Service Delivery (ISD).
My Stamp 1 permission expired on 28 June 2026. My employer initially allowed me to continue working during a 12-week grace period, but that period has now passed.
I have now received an email from my employer stating that if my immigration permission is not resolved by 28 October 2026, they will no longer allow me to remain on the work roster because of compliance concerns.
I’ve worked for the same employer for 3.5 years, averaging around 35 hours per week. Losing my job would have a serious financial impact on me, especially when the delay is outside my control.
I’ve tried contacting the WRC office in Cork by phone and also visited in person, but I haven’t been able to speak to anyone about my situation.
I understand that having a pending application does not necessarily mean I can continue working legally, which is exactly why I need clarification from the relevant authorities.
I’d really appreciate advice on the following:
Has anyone applied for Stamp 4 under the Turkish Association Agreement and waited this long for a decision?
Has anyone in a similar situation managed to get an urgent update from ISD?
Is there a solicitor in Ireland who specialises in Turkish Association Agreement applications and judicial reviews for unreasonable delays?
Can an employer legally stop employing someone in these circumstances, and could there be any employment law implications?
Has anyone successfully contacted the WRC for advice about a situation like this?
I’m not looking for special treatment. I just want clarity about my immigration status and the right to work while my application is pending.
Any advice or personal experiences would be greatly appreciated. Thank you.

Immigration and Citizenship Can Stamp 2 IRP holders apply for a medical card/GP visit card?

A chairde, I'm a non-EU international student (Stamp 2) who will be resident in Ireland for at least the next four years. I have my Irish Residence Permit and PPSN, and a DPS card, but I’m worried that a medical card/GP visit card could count as public services/benefits. Will they, or am I ok to go ahead and apply? I had the same concern about the DPS card but it seems like that’s fine. I just want to make sure I don't get flagged next time I renew my IRP. Grma!

Residential Tenancies Rental agency ending management of the apartment we're living in?

We literally just moved into this apartment a few weeks ago and woke up to an email saying that the rental agency "will cease its management of your property, and your license agreement with us will end." Followed by a vague instruction that the new property manager will be in touch at some point to let us know what's next.

How much should I be worrying about this? The contract we had was pretty flimsy, but sure they've ended it anyway so technically we're in limbo right now. I'm concerned the new agency will either a: evict us, or b: increase the rent which we cannot afford.

If either of those things happened do I have any legal grounds to fight it? Thanks

Advice & Support Deeds, not what I thought?

I will try keep this short as possible.

I was under the impression I inherited my home from my parent but there was an issue with paperwork and they died suddenly. So my step parent said they were looking after it (I was in my very early 20s, so I had no clue). I was under the impression my step parent had a right to residence. I have just discovered a will they made for me (without my knowledge) that states they are a tenant in common. I have not signed this will. Having looked the term up it would seem like that have a percentage of ownership?

I am living in a very volatile situation so I can't physically get the deeds to look at until they leave the house for an event over the weekend. What should I be looking for when I get them?

I took it everything at face value so I have never looked at them closely.

Advice & Support Strike days and afterschool childcare service

I work in an after-school service that is based in a primary school and up until earlier today both the staff and the parents had been told that we would close tomorrow due to the strike.

One of the parents (with two children in the service) was extremely unhappy about this and was demanding that we open anyway since the teachers are not directly restricting access to the school, the only issue would be crossing the picket line.

Just an hour ago my manager has informed me that we will be forced to open the service tomorrow despite the strike going on outside for his two children because he has threatened “to sue us for not opening “.

My question is does he have an actual legal complaint? My guess would be that since we are a private company we can close the service for any reason, but we probably must offer a refund/compensation?

Any advice would be appreciated, thank you.
