u/BringOutYDead 1d ago
Remove Presidential pardons. Make them by commity only.
35
u/DustyScharole 1d ago
I think they're fine, but they need to be for specific crimes. The idea of a blanket pardon is just asinine.
27
u/hardatquirk 23h ago
Or you have to specify the crime, for which the person must have been found guilty.
I'm for pardons being available. As a former attorney (who did pass the bar in illinois) I have seen many cases where I felt that some mercy was needed to arrive at a truly just result. For some people, that mercy can be a pardon.
4
2
u/Supersauger5854 12h ago
And how often does that happen that those people get a pardon?
1
u/hardatquirk 9h ago
That's a question that doesn't have a satisfying answer. Governors and presidents that want to be reelected don't want to appear to be soft on crime. My personal standard for mercy would be used by a political opponent to make a sitting politician appear weak.
So to fit my standard, we need societal change that results in a people that aren't so obsessive with punishment. As it stands, our society would rather throw a person to the dogs than see them as reformed or deserving an authentic second chance

Nah, I think they should exist, but there needs to be a big exception zone around the president himself (or herself or themselves in an less chauvinistic future):
No ability to pardon self, family members, administration staff, anyone that President has appointed to any government post (esp judges), any senator state governor or house rep of the presidents party, or anyone involved with crimes directly connected to the president.

If the Democrats want to restore law and order then they need to ignore his pardons. If they don't then the law has no value, how can it have any value when a felon is allowed to break it as he please and then hide behind it for protection while his victims try to put their lives together?
This cannot be allowed to happen. For law and order to mean anything, there has to be consequences for Trump and for everyone who helped him violate our nation.
10
u/SpaceCadetHise 21h ago
If I remember correctly, treason is not pardonable.
5
u/Artistic-Cannibalism 21h ago
They'll just say that he's not a traitor and any attempt to investigate him is violating the law and is actually treasonous.
Democrats should not listen to those people.

u/ObligatedMediocrity 1d ago
I despise trump but I have yet to see a single reason why I should listen to this nobody about anything. His only claim to fame is being fired by Trump almost immediately. There is nothing else interesting about him, and yet the media hangs on his every word. They did the same with Omarosa for a while, two people who would still happily obey every word trump says if they hadn't been fired.
8
u/AmericasNextTopHobo 19h ago
Frankly, this is an optimistic outlook.
What will actually happen is that Trump will say the elections were fixed. He, Johnson, and Vance will refuse to seat the new Democrat congress people. He will declare marshall law and enforce curfews in DC.
And then weâll see how much Americans want democracy.
6
u/Saltwater_Thief 19h ago
They don't get to refuse to seat them because it's not their purview. The Clerk of the House seats the new House because there is no Speaker until the new majority elects one, and before someone brings up the notion that they'll install a clerk who will do what they say the timing required to do so is razor thin and likely beyond Johnson's capacity.
As for the Senate, Vance trying to do that would be extremely dangerous because of the carryover constancy- unlike the House it's not a fresh slate, votes of import are taken based on a majority of those present to vote, and if the Senate flips it will mean the GOP lost seats while the Dems did not. It would depend on exactly how the numbers shook out, but the Dems would likely still have a simple majority of those present- which would enable the nuclear option.
1
u/AmericasNextTopHobo 18h ago
Of course itâs not legal. Trump doesnât care about legal.
Plan A is to use Russia, Elon, and the Supreme Court to steal the election. If that works, itâs his best option. Plan B is to prevent the election entirely using âwar powers.â Plan C is to invalidate/deny the election results, delay seating democrats, and conduct a fake âinvestigation.â
Itâs all illegal.
3
u/Saltwater_Thief 16h ago
You misunderstand me.
I am not saying "They can't do that because it would be breaking a law", I am saying "They can't do that because that is literally not how it works." All of their doings so far have been theoretically arguable as part of executive powers; this is by design, because it enables them to stand enough of a chance in the judiciary that their packed court could stamp them with help from Roberts, Barrett, and Gorsuch (which is why they need the theoretical standing). This notion of not seating democrats that win has no such ground to stand on.
1
u/Woody1150 15h ago
While I get what you are saying, I wouldn't put anything past these lunatics. Look what happened the last time he lost, he convinced a bunch of people to try and overtake the capitol and almost kill people that did not do his bidding. That delayed things for a little while then, who knows what they would try since they have the majority.
1
u/Sea_Mind3678 1h ago
And they tried to declare the certification invalid because of something like âthe law says it has to occur on a particular day and it didnât because they had to clear the place out and reconvene in the middle of the nightâ. It sounds like the kind of âlegal argumentâ my kids would dream up to prove that legally I had to order a pizza if they didnât like what I cooked for supper, or some similar stupid thing.
1
u/Technical-Command867 12h ago
Neither has any of the bullshit Trump had done. He does what he wants and he has many deranged loyal supporters who, idk, would storm a capitol at his request.

The Founders had a lot of blindspots. They never thought Congress would cede power to the Executive.
But I don't think even martial law can do what maga thinks it can do. But I think Americans will truly riot if they try.

Sadly, this is what I believe Trump will try and do. It will be up to the US institutions and media to hold him to account. If they fold, he will succeed.
3
u/Wild-Floor8407 23h ago
I dont agree with his thoughts on this or probably anything, but him being right about this or not I wouldnt put it past the mango to doReich.
Personally I forsee electoin tampering in any way imaginable, up to and more than likely including voting machine fraud through Muks, stealing ballots, thugs at polling places, "hand recounts" done by the DOJ or ICE, voter roll tampering, and mail in theft/tampering. If not flat out martial law and canceled elections. Followed by more martial law and the coup de gras to start the 4th reich. I hope to God im wrong.

u/TheVirginVibes 20h ago
Donât you have to be convicted of a crime to receive a pardon?
3
u/ElvisArcher 20h ago
It should come with a statement of exactly which crime they are pardoned of, especially in the case where the individual has not even been accused or convicted of a crime. In those cases, the individual should then be required to sign an affidavit admitting guilt to the crime to qualify, and all of that should be public record, not sealed in hidden court records.
In cases where the individual is already incarcerated for the crime, their guilt is already court record.
3
u/Turbulent-Prior-2253 20h ago
No. Most famously, Ford pardoned Nixon despite not even having charges filed.Â
1
u/thebuffshaman 19h ago
No, you can be pardoned of a crime you commited, you can be pre-pardoned of a crime you will commit on behalf of the country, neither of which you need to be charged, let alone convicted of. Many of the J6ers had not been charged yet and they are covered under his blanket pardon.
1
u/The_Rope_Daddy 10h ago
What do you mean by "pre-pardoned"? A pardon has to for actions already taken before the pardon was given.
1
u/thebuffshaman 8h ago edited 6h ago
>>>edit<<< Misread your response so my initial response was making no sense. If it is anticipated someone doing something for the executive may violate the law they can be pardoned before hand with some ambiguity and has been upheld by the courts. It is something that started during the cold war and with this president and supreme court could probably be used for anyone for any reason which would be an expansion.
1
u/Minimum-Attitude389 15h ago
You don't even need to be charged to get a pardon. Like when Carter pardoned the people who refused the draft.

If they have pardons they have to testify.
1
u/Cumminpwr11 1d ago
I plead the 5th is a testify and protected.
4
u/Anxious_Drive_9998 23h ago
If there's a pardon they can't please the fifth because there's no potential incrimination.
3
u/Significant-Order-92 23h ago
The 5th protects from incriminating yourself in a crime. If you are pardoned (at least federally) you couldn't be charged by testifying to having committed the pardoned crime.
Now that doesn't protect from state or civil action.
But congress did request Fauchi be held in contempt since he was pardoned.
3
u/Impressive-legit-FTD 20h ago
States can still go after every one. Which is what will have to happen. His pardons are only covering federal jurisdictions.
3
u/Immediate-Count-1202 1d ago
Is a viable option to charge many of them for crimes at the state level?
1
u/Minimum-Attitude389 15h ago
Sometimes. Unless they are federal officials or employees, in which case it can get transferred to federal court.
2
u/theZoid42 1d ago
Correct me if this isnât accurate, but a pardon a day 1 of new Congress, a subpoena to testify on day 2 that is ignored is not covered by the pardon. Yes?
1
u/Cumminpwr11 1d ago
No he can pardon people the day of and retro active it as long as he wants. Anyone that gets subpoenaed can walk in and say nothing. They have full immunity and canât be charged by exercising their 5th amendment and refusing to answer any questions. If there is no repercussions for them like an illegal crime they can be charged with to force corporation to save themselves.
1
u/Significant-Order-92 23h ago
Actually a pardon may mean a lack of coverage for the 5th. At least that's what they claimed when Fauchi invoked the 5th in congress.
1
u/Slighted_Inevitable 22h ago
This is actually incorrect. They can be charged with contempt of Congress for not answering. Being immune does not mean you donât have to speak about it. In fact itâs quite the opposite.
His pardons would break their fifth amendment rights because they canât be charged for the crimes they are confessing to.
1
u/Cumminpwr11 22h ago
I stand corrected. I did learn that people have the choice to accept a pardon or not and the offer can stand for a set amount of time. So they cannot take the pardon at that time, plead the 5th and then get pardoned after they walk out of court.
They can also still plead the fifth if the question could lead to state level charges as well. The 5th is just about federal charges.
2
2
u/pyrotek1 20h ago
Presidential pardons pertain to federal crimes. The states can bring their charges including any paused convictions.
2
2
u/Sarabeth68 14h ago
We need a bill that says if the President is impeached, the pardon received is nullified if the person is connected to his crimes. The person is a a co conspirator, the crimes are pre meditated due to the planned and anticipated pardon , therefore the pardon was not in good faith and was used in the furtheranc of criminal actions.
Not saying it would not get vetoed rn, but it is something that needs to happen at some point, if we keep our democracy.

he can't blindly pardon. His power ends in 2028. His pardon power is gone after that. So they needs to be charged first. They need to confess every crime they did so that later admin can't find another charge. Then TACO can pardon. It will be shitshow. I don't think they can completely pardon everything they did. many, including TACO don't think a lot of thing they did is crime.

u/OMA--AMO 22h ago
Asked AI:
A pardon generally makes it easier to compel them to testify, not harder. The main legal shield against testifying is the Fifth Amendment right against self-incrimination. That right only protects you from answers that could expose you to prosecution. Once someone is pardoned for federal crimes, they can't be prosecuted for those offenses, so they usually can't "plead the Fifth" about them. A court, grand jury, or Congress could then subpoena them and, if they refuse, hold them in contempt. The Supreme Court's 1915 Burdick v. United States decision also says that accepting a pardon carries an implication of guilt, and a person can decline a pardon.
1
u/An_Old_IT_Guy 22h ago
If he pardons everyone around him they'll have no excuse not to testify against him but that's none of my business meme that I'm too lazy to make so sue me.

Does being pardoned limit your fifth amendment right since you cannot be implicated for the crime youre testifying about, due to the pardon?
I thought that was established precendent...
1

The problem with that is a pardon negates ones right to avoid self incriminating (5th amendment). This means you no longer have the right to remain silent.

u/Justin-Truedat 17h ago
Pardoning people is a double edge swordâŚthey can no longer invoke the 5th amendment if compelled to testify.

Every president pardons people. In his first term Trump pardoned the father of his son-in-law. He didn't give blanket pardons to blood relatives but now that it was done by Biden I expect Trump will do it this term. Everyone that was happy for Hunter will cry about Eric and Don Jr. Then the cycle will continue.
1
u/MunchingOnCelery 23h ago
No he just gave blanket pardons to actual criminals. Biden merely followed the precedent to protect people who were innocent. No one is responsible for the precedent except Trump.

Wrong. The weaponized lawfare Republicans attempted against Fauci proved that Biden was correct.
On the contrary, the people Trump pardoned were all convicted criminals who were not victims of anything but the legitimate consequences of their behavior.
This is why you show some intellectual honesty and learn to differentiate between the factual details of the situations instead of assuming there's a tit for tat team kayfabe happening here. There isn't.

Anyone that votes for a candidate that says impeach Trump is there for sensationalism and pandering to the feeble minded.
We need people with a real plan to make changes not impeach Trump. The presidential office is irrelevant if they have a veto proof Congress and sweeping change can happen.
If they try to impeach, they want to waste tax dollars and screw over Americans. Trump will pardon everyone including Vance, resign and have Vance pardon him making the whole thing a waste of money.
Only candidates with logical plans with real budgets on how to accomplish their ideas.
