Mod Post Read before commenting: Off-topic and anecdotal comments are not allowed and subject you to a permanent ban

Greetings from the mods!

We've had a flood of off-topic comments recently. We're posting this to remind everyone that off-topic and anecdotal comments are not allowed. An off-topic comment may subject you to a permanent ban.

The Rule:

Commenting Rule 1: Comments should contain a legal answer or a strongly related non-legal answer. If it is not legal advice, do not post. Period. You will be banned.

What is "off-topic?"

Any response that doesn't answer the question by reference to legal information or principles. A joke, a wisecrack, a comment about OP's formatting (use the report button instead) are all off-topic. Off-topic also includes expressions of sympathy, opinions on the law, and comments that berate the OP or anyone else.

Incidentally, simply adding "get a lawyer" to an off-topic comment does not make it on-topic. And "get a lawyer" on its own, without further information or help, is considered unhelpful and may be removed on that basis.

If you want to discuss a post, then wait until it hits /r/bestoflegaladvice or ask a question about the subject of the post in /r/legaladviceofftopic. The main subreddit and a comment thread are never a place to have a philosophical discussion about the law or the post. It is a place to answer the questions asked.

What is an "anecdote?"

For our purposes, anecdotes are stories about something that happened to you (or someone you know or heard about) who may have had something that might be similar that happen to them.

These comments are not helpful. They do not include current legal information that is relevant to the OP, and therefore, they are off-topic. If you know the answer to the question (based on current law and relevant jurisdiction) then just answer the question without the story.

Another type of anecdote is "I don't know the law in the jurisdiction you actually asked about, but in some other state, the law is..." That is just not helpful. Laws are different in different places. These types of answers are off-topic.

Referring an OP to a thread on a different subreddit, or to somewhere else on the Internet because it might include a similar situation, is anecdotal advice and not allowed.

These are not the only types of anecdotes, but they are probably the most common ones. Again, if you are not referencing legal information or principles, your comment is probably not allowed.

Violations subject the user to an immediate and permanent ban

Not that we need to justify enforcing our rules, but this is a busy subreddit and the mods have a lot to do. If a user shows up here, doesn't read the rules, and posts a single off-topic comment, the user may be immediately and permanently banned.

This policy is not intended to be punitive, although we know it may seem to be. There are a lot of you and not many of us, and banning users that do not follow the rules, even once, is in the best interests of the subreddit. Violating the rules almost always means the user didn't bother to read them, and we simply don't have time to deal with such users.

Tl;dr: Unless you have a legal answer, do not reply to any post in this subreddit. You may be permanently banned, even for a first offense.

Subreddit Rules

We've learned that some people just flat out can't see our subreddit rules, so I'm posting them here in a pinned post so we can link them when necessary and so they're super easy to find.

Rules for r/legaladvice Rules that visitors must follow to participate. May be used as reasons to report or ban.

1. All responses must offer an answer to the legal question posed by the OP. We enforce this with bans.

Anecdotes are not permitted. Neither is advice that encourages someone to break the law. Nor is "get a lawyer" a sufficient response.

There's a pinned post at the top of the subreddit specifically addressing this rule. We will absolutely ban you for commenting without answering the legal question

2. Personally Identifying Information

Posts or submissions that ask for or contain information that could be used to identify either party are subject to immediate removal.

3. Advertising or Recommending a Lawyer or Business

We do not allow referrals to particular lawyers, law firms, or other businesses.

4. Do not request or send a PM

All discussions must stay on the subreddit for everyone's protection.

5. Include your location

You must include your location in the following format: location: yourlocationhere . It must be that exact format, and it must be in the body of your post.

6. Read our full list of rules

Read our full list of rules here: https://www.reddit.com/r/legaladvice/wiki/index#wiki_general_rules

7. This subreddit is for simple legal questions.

This subreddit is for simple legal questions. We can't help with preparing a defense, legal research, etc. We cannot review contracts, plan your defense, or give you specific advice on exactly how to present your case with the court. You need a local attorney for that. Additionally, we do not accept medical malpractice questions.

8. NO LLMS

No LLMs. No ChatGPT. Don't recommend it, don't use it to answer questions, and don't use it to compose your modmail when you get banned for using it. Using it to compose questions is generally ok.

We will permanently and irrevocably ban you for this.

9. Mods can remove things we deem inappropriate or disruptive

Any post and any comment can be removed by the mods at any time if the mods decide the post/comment is or has the potential to be disruptive or is otherwise inappropriate.

10. Posts must be about a real scenario that you or someone you know is facing.

To expand on this, we additionally do not allow anyone but the immediately involved parties to ask custody related questions. Not friends, not significant others, not grandparents. Reddit is free.

11. Post must contain a legal question

A legal question is one that can be answered with the law, be it a law or ordinance, or caselaw.

12. US and Canada only

Laws are different everywhere. We can only help with legal problems in the US or Canada because we have no regular, reliable commenters from other countries. For other countries, please search for an appropriate subreddit.

Real Estate law Purchased my home 2 years ago and now this where do I stand

Bought a home over 2 years ago , 6 months ago my front door was knocked on at 7pm. It was the guy who rents/farms the field next door, said our septic was leaking into field, he said i needed to do this and do that, I disregarded as we had a septic "inspection" the renter of the field called health department and long story short they determined a lateral of mine is tied into a field tile in the field over a 1000 feet from property line. And now we have to get everything up to code. What can I do? I did not do this , this was done before I was born as I looked into it and at one point a previous owner owned my property/the farmland and the farmhouse across from us. I am just trying to be a home owner and hit with this. Where do i stand, what can i do? The health department is making me out to be the culprit and blaming me. Thanks LOCATION: midwes usa illinois

Employment Law My boss is telling me to pay him back after firing me.

1.5k Upvotes

A couple months ago, I was fired from my job, I was getting ready to move in to a new house with some of my close friends, to make bills and living cheaper on all of us. My old boss knew I was moving into a new home, and decided that he would give me and extra $1000 for moving expenses, I didn’t sign anything for the extra money nor did I make any deals for that 1000.

A couple months later he texts me out of the blue asking if I filed for unemployment, which I did. Then he proceeds to pressure me into stop filing for it because he thought the 1000 dollars would be enough for me to hold myself off until I found a new job. Of course I told him it’s impossible for me to do such while I’m still searching for a job, as well as paying for groceries and bills.

Finally he tells me I either pay him back and keep my unemployment, or I take myself off of said unemployment. I haven’t texted him back and wanted to seek advice about the legal ramifications about all of this before anything. Any and all information helps! Thank you!

Location: Virginia

UPDATE: I appreciate all of the messages and information you guys have all shared and I took A LOT of it into consideration, so thank you all so much! I’ll be sure to update if anything new happens.
I left one final message regarding my choice to continue my unemployment, as well as reminding him that there was nothing on paper or recording of me agreeing to any deal about me not going on unemployment, as that was never even a topic when I was fired from my position. I let him know that any further communication on the matter will be considered harassment.
When I was officially fired, he gave my final check as well as a separate check for $1k because he wanted to “help me out” I can tell that’s not the case now. And then I proceeded with my unemployment application a couple days afterwards.
That place was always shady, and being there for 5 years straight can’t say I’m really surprised this is happening.

My ex fiancée wants a protective order

Location: Indiana US
Ok reddit, so last weekend I was served paperwork stating that my ex fiancée is taking me to court for a protection order.

Backstory information: Me and her ended up having an ugly breakup after 4 years. This was 3 weeks ago now when she packed her things and left the house snd moved back with her parents. She has been back to the house three times since to collect more of her belongings. First two times I was there, third time I wasn’t. Both two times I was there we ended up taking a lot and even being intimate. The third time i wasnt she also took a bunch of my belongings. As far as the house goes the mortgage is in her name so technically i am living in her house now and she is effectively my landlord. There has been almost no contact since she left the first time.

Now honestly, I dont want anything to do with her anymore but I do want my belongings back. So as far as the protection order stopping me from contacting her i have no problem with. But i need to sue her for my belongings as well as she has all the information for the bills in her name so I cant pay or see what that status of them are. she has no job so i know its not just getting paid.

I also want to add that there was never a case of violence at any point during our relationship, even since it ended it never got violent.

So, is there anything I can or should do? Currently still live at the house, haven’t received an eviction yet. If she does “win” how does that affect me. I will be answering questions all day so please ask and send your advice.

Court is friday this week.

Employment Law My wife is owed at least $16,000 but her job has only paid her $2000 total in 3 payments since July. Now they want part of it back

Location: Michigan

Posting for my wife. She's a newly licensed therapist (LLMSW) who started at a private practice in July as a 1099 contractor. She never got a written contract, even though she's asked the owner for one repeatedly. Every time, the owner says they'll get around to it, and they never do. The verbal deal is that she keeps 60% of what's collected, which is the same split the other therapists have in their signed contracts.

She's seeing about 12 clients a week. Since July she's been paid three times: roughly $600, $700, and $1,000. The owner now says part of the $1,000 was a double payment for some cash-pay sessions and will be taken out of future checks. Meanwhile, other cash-pay sessions were never paid at all. A month ago she got a brief look at the billing system, which showed at least $16,000 in her sessions ready to be billed.

It's not just her. All of the roughly 23 therapists there are in the same spot, and one of them is now on food stamps.

The practice replaced its billing company with a part-time in-house biller who has no experience and is a client of one of the therapists. After that, the therapists lost access to their own billing records. The biller sends them to fix insurance problems with clients, unpaid, and the claims still don't get paid. My wife has a workers' comp client whose sessions haven't even been submitted because the biller "hasn't gotten around to it."

She has her own session log, pay statements, and plenty of texts from the owner admitting the problems and promising to fix them. No date ever comes.

We're living paycheck to paycheck. She's 6 months postpartum and we have a baby to feed, so this isn't extra money for us. She wants to stay until she's fully licensed and just get paid for the work she's already done.

She's also a green card holder. She hasn't done anything wrong, and pushing for her pay doesn't put her status at risk, but with how intense the current environment is around immigration, she really doesn't want the stress of a big fight. Between that and a new baby, she just doesn't have room for it. That's a big part of why she's put up with this for so long, and why we're looking for the cleanest way to get this resolved.

What can she do to get paid when the agreement was only verbal?

Does she have a right to see the billing records for her own sessions?

Can the practice take the double payment out of her future pay when it still owes her far more than that?

Is she really a 1099 contractor, or could she count as an employee, given how much the practice controls (rates, billing, required meetings, its offices)?

What's the smartest first step: a demand letter, small claims, or a lawyer, especially if the other therapists join in?

Other Civil Matters Neighbors dog has been at our house for 3 months straight and had puppies here 3 weeks ago. Do I have any legal rights to them? Mississippi

Location: Mississippi: My family and I moved to Mississippi over a year ago. Our neighbors have a dog they let free roam, she started coming to our house and refusing to leave. She would occasionally go back to their house for a few minutes at a time, maybe once or twice a week just to greet them, but they ignored her so she stopped even doing that. For the most part, she's been at our house nearly 24/7 for at least a year.

We're very attached to her, and she is to us as well. Recently she got pregnant again because her owners refused to let me get her spayed, even though I offered to take her, pay for everything myself and take care of her afterwards. They claimed they would take her to be spayed but they never did.

When she went into heat, I had to lock her outside of our house and gate to prevent her and my male dog from breeding (he can't be neutered yet due to health issues, he's a rescue). She stayed outside of our gate whining to get inside. It was making my male dog physically sick from the stress of wanting to get outside to her. We eventually had to leave the state and spend a week and a half staying with family until her heat cycle ended. During that time, my uncle, who lives with us, told me she slept on our porch on the dog beds, and he fed her while we were gone and he said she never went home.

There have been several times when she needed medical attention, and her owners did nothing. At one point, she was sick for a week, she wasn't eating or drinking. I took care of her because her owners ignored me when I contacted them about how she was feeling. Later, she hurt her shoulder and limped for like four months. I told her owners about the limp and she acknowledged it and she told me they were "monitoring her." Meanwhile, she continued spending nearly 24 hours a day at our house.

About four months ago, I texted the owner and explained how much the dog means to us, how much we love her, and how we wanted to keep her and get her properly vetted. For some reason, that seemed to make the owner even more annoyed and spiteful toward me. I eventually dropped the subject because I didn't want to start a conflict and hurt the dog some how. Ever since then, she's been hostile towards me. She comes across as a very mean and spiteful person to begin with.

Recently, the dog got pregnant again, and throughout her entire pregnancy, she stayed at our house and refused to go home at all. When she was getting ready to have the puppies, I let her outside because she wanted to go onto our porch and I contacted the neighbors to let them know what was happening. I wanted to give them the opportunity to come and get their dog before she went into labor.

Their responses were dismissive. The owner responded with short messages like "nope, haven't seen her" and "haha,". or "hope she doesn't have too many puppies." She ended up having them inside our house, I made her up a place because apparently they were not coming to get her. I sent the owner pictures and updates while she was having puppies, but she continued responding with short, dismissive texts or not at all.

That was three weeks ago. Since then, the owner has sent only one text saying something about coming to see the puppies. Every other message has been from me, updating her about what's going on. I also asked what they planned to do with the puppies, and she told me I could give them away because that's what they planned to do anyway.

A few weeks ago, we had a hurricane near our area. We saw the owners at a local store in town, and they told us they planned to leave for the hurricane, they were going to go three hours away (one way) 6 hours total. The storm wasn't even expected to be bad where we live, so we decided to stay home, all we got was a little rain and wind anyway.

While at the store, prior to the hurricane, the owners told us they were going to come get the mother dog and her puppies and take them with them, which would have meant a three-hour drive each way with puppies who were only about three days old and have them stay in a hotel room. On the day the hurricane was supposed to hit, the owner texted me and asked if we were leaving. I told her we weren't, and she asked if the dog could stay with me. Of course, I said yes.

The mother and puppies have been with us ever since as well, and it's now been almost three weeks. I feed the mother every day, she sleeps inside my house, I bathe her, and I take her on walks. I've been taking care of the puppies as well. I've also been taking timestamped pictures and videos to prove all of this. I even had a livestream of the puppies running for a few days to show that they were here 24.7.

This dog has spent nearly a year at our house, almost all day, she has now been staying with us continuously for about three months, and her puppies have been here since birth, 3 weeks ago.

Some background about these people that has me extremely worried about what could happen if the dog goes back to them.

According to other neighbors, they don't take proper care of their animals. They have a bloodhound who has been chained up at their property for five or six years. She keeps getting pregnant, and the last time she had puppies, the owners shot and killed four of the puppies because they chased their chickens.

A neighbor who is friends with both me and the dog's owners, told me that she was visiting the owners one day back when the dog would go back and forth between our homes, the dog chased their chickens, according to my neighbor, the female owner started beating the dog with a stick, kicking her in the stomach, and punching her in the head.

The problem is that we live in a rural area of Mississippi where we don't have animal control. The female owner used to work for the sheriff's office and still has connections there. Other people told me that they have reportedly tried to get something done about these owners and their animals in the past, but the sheriff's office refused to do anything.

I'm really worried about what will happen if they decide they want the dog back. I'm really worried they might decide to chain her up like their other dog.

Another thing, my family and I are thinking about moving in six months or so, and I'm trying to figure out what my options are before then. If we move, I would love to take her with us, but I don't know whether I have any legal rights to her or whether I could get into trouble for taking her?

I have timestamped photographs, videos, witnesses and text messages showing how long she has been staying with us and the care I've provided. I also have text messages showing that I contacted the owners about her health, offered to pay to have her spayed, updated them throughout her pregnancy, and agreed to keep her and the puppies when they asked me to during the hurricane.

Do I have any chance of legally keeping this dog? Is there anything I can do now to establish ownership or protect her legally so if we move states I can take her with us? What would happen if the owners showed up tomorrow and wanted to take her and the puppies back? Would I have any legal grounds to do anything about it?

I really love this dog, and I want to give her a safe home so I'm playing nice for now, so she doesn't suffer at the end of the day.

What are my actual legal options in a situation like this? If any?

My employer wants me to sign safety records from before I even worked there

Location: Ohio

I work at a small food packaging plant. We recently had a safety inspection and management has been trying to get everyone's training paperwork in order.

My supervisor handed me several forms confirming I'd completed machine safety training earlier this year. Problem is two of those forms have dates from before I was even hired.

I told her I'd sign for training I actually attended, but not something that never happened. She got annoyed and told me I was making a simple thing difficult.

Yesterday I noticed all my shifts for next week were removed. When I asked why, she texted that I couldn't return until my employee file was complete.

I have pictures of the forms and the messages. Is this something I can report as retaliation, or can they legally take me off the schedule for refusing to sign?

Business Law I own 50% of a business, but my partner won't allow me to hire an employee even if I’m willing to pay out of my pocket. What are my legal rights? (California)

I’m a 50% owner of a coffee shop in California, structured as a general partnership. My business partner and I have spent years building this business, and I’ve invested a significant amount of time, effort, and money into making it successful.
We currently split the days we operate the business.
I would like to hire an employee to cover my designated shifts so I don’t have to physically work at the business every day. I’m willing to pay the employee’s wages, payroll taxes, and associated expenses entirely out of my own portion of the profits.
However, my business partner refuses to allow me to hire anyone.
He has also told me that I either need to continue physically working at the business because “this is America,” or sell my 50% ownership to him.
I don’t want to sell. I’ve worked incredibly hard for years to build this business, and I believe I should be able to retain my ownership while finding a reasonable staffing arrangement.
I’m not trying to avoid my financial responsibilities or leave him with additional work. I simply want to hire someone to handle my shifts at my own expense.
My questions are:
Can my business partner legally force me to sell my ownership because I no longer want to personally work my shifts?
Does being a 50% owner mean I’m legally required to physically work at the business?
Can he prevent me from hiring an employee if I’m covering all the costs from my own share?
What rights do I have if we’re at a 50/50 deadlock?
What kind of attorney should I consult to protect my ownership and negotiate a fair management agreement?
I’m looking for guidance on how to protect my investment and ownership without escalating the conflict unnecessarily. I would appreciate advice from anyone familiar with California partnership law or who has experienced a similar situation.

Location: Bay Area, California

Edit: THANK YOU EVERYONE FOR THE REPLIES. I’m meeting with an employer attorney this week.

Employment Law Terminated shortly after reporting a major safety and compliance issue

Location: TX / OK US

I was just terminated.

June - reported out of compliance discovery to my supervisor, manager, and director via email.
July - had my work access locked out and sent a random screening. I noticed I couldn't access my emails so I contacted IT. Which unlocked my account and said that I had no logs or notes of why my account was locked. I have confirmation of this from IT. After getting into my email, I see the random screening. I believe they sent the random and blocked me from seeing it as missing or becoming a no-show would be a terminating offense.

I managed to get back into my email with enough time to take my random the next morning.

September, my supervisor appears in my area of operation for the first time ever, and the first time in the state I am working in. He drove over unannounced 8+ hours to surprise me and see what my day to day activities are.

The following day the director and my supervisor wanted to move me out of state and begin performing work 8+ hours away from my home. This is new. After 18 months, they want to drag me out of my state.

That day I reported them to STAA under OSHA.

I received my OSHA paperwork from the investigator on week 3 or Sept 2026. OSHA told me the employer would receive their notice of the investigation a day after I receive mine.

4 days later I was surprised by my supervisor, and handed paperwork. He told me to go home. He wouldn't say it was a termination, but wanted my laptop and electronic devices. The paperwork says its a confidential severance agreement. A few days later I was emailed from corporate with another notification that I have been terminated.

I did not sign it. Do I let the OSHA investigator know I was terminated?

Coworker stole debit card info and spent over $700 USD, evidence is on camera.

Location: NYC.
Noticed on my bank app there's been some purchases that I had not done on Sunday, so I called my bank to close my debit card and ask for a new one. They said they could not refund me because the payments were still pending, and to call back once they went through to open a case and a refund request.
I leave my bag in the work area right next to a camera just to be sure, and it caught one of my coworkers on Friday fiddling around my bag and taking pictures of my debit card after they took it out of my wallet. I spoke to my manager and sent him the videos, he said we'd be contacting the police about it tomorrow.

I would like advice on what to do moving forward? How should I proceed with the Bank and the Police? What should I expect from similar cases like this?

Thanks for the help!

Can an employer legally tell you that you cannot be friends with or see coworkers outside of work?

I am employed in the state of Georgia by a retail employer that is based in California. My company is trying to say it is policy that we cannot have friendships with or have any interaction with our coworkers outside of work. Can they legally do this? For some basic policies it seems like they go based on California laws but others seem to go by the state in which the individual store is. It’s like whichever suits their needs better that’s what they go by 🙄 I have scoured our “handbook” and cannot find anything about this policy but yet our district manager keeps reiterating it so I’m beginning to wonder if it’s even legal for them to say this in either state.

Business Law An Arizona web domain provider seized all my domains, suspended, and locked my account because of a 'routine check' after I didn't reply in 72 hours with my ID to a single email.

I have been with them for 12 years, never once this had happened before. No domain is used for any illegal purpose, and not even marginally illegal, they are just boring business. I had one forum but it's been disabled for almost 14 years. All my domains so far are renewals, I hadn't logged in to my account in almost 20 days before the incident, and didn't make any changes or charge-backs or anything.

They sent me a single email, which I didn't notice on time, then proceeded to suspend everything and lock me out of my account. The lockdown happened this Friday (16th). I noticed and went to chat with them, they refused to provide any further details and mentioned I needed to contact through email, even after I explained what they just did disabled my server completely. Just went full cop mode 'we'll contact you' but never provided any straight reason, justification, evidence, nor anything, and haven't provided any detail to this date. They just said I was breaching their ToS. The only info I have is mentioned as I breaching the "Accounts, Accurate Information, Transfer of Data Abroad" of their ToS.

What they disabled with this, besides my domains was my main hostname, which links everything together so my server and the service to all my clients. Everything went offline, like 50 business, because of this.

I submitted an old ID first the very same Friday (I freaked out and thought it was a scam or a hack), but they told me it wasn't valid so I sent a new one that day. Since then they haven't given any other answer except "we'll contact you", it's been 72 hours since then.

My clients are furious, they have a lot of problems with logistics, government, tax offices, customs, etc. and are pressuring me constantly to get it fixed. I have been not great with the stress but I'm managing it.

I don't know what to do, since I'm in another country right now and can't travel to the USA to deal with it, and also don't have the money to pay for a lawyer.

I don't know if ICANN will look into this and how much time it'll take and if my domains will stay locked longer because of it.

The company is aware I'm being public about it and was warned several times about it, I've ranted at them, leashed out and told them I'd get this to be very public, since I don't have any other tool.

I don't really know what to do.

Insurance Rental car hit my parked car and ran. 3 months later, still nothing. Should I sue?

• Upvotes

Location: CA

So about 3 months ago, someone driving a rental car hit my parked car and took off. Luckily my dashcam caught the whole thing, including their license plate.
I contacted the police and they were able to look up the vehicle and give me the insurance information. I’ve been dealing with the rental company’s claims department ever since, but they keep telling me they can’t confirm who was driving because the renter won’t cooperate.
It’s been 3 months now and I haven’t gotten anywhere. They never reach out or give me updates, I’m always the one calling them.
My car has been sitting unrepaired this whole time, with about $3-4k in damage. I also only have liability insurance, so my own insurance won’t cover it.
I ended up getting an attorney involved, and even she couldn’t get anywhere with them. Now she’s recommending that we sue for around $15k, including loss of use, but it’ll cost me $3k upfront in legal fees.
I’m honestly not sure what to do at this point. I have dashcam footage, police documentation, and everything, but they still won’t do anything just because their renter isn’t cooperating.
Would you guys actually go through with the lawsuit? Is it even possible to get compensated for the 3 months I haven’t been able to use my car? And if I win, would I be able to get my attorney fees back?
Just wondering if anyone’s been through something similar or has any advice.

Landlord Tenant Housing Landlord failed to appear for court, how to collect judgement?

Location: Virginia

My landlord did not show up to the move out inspection and did not return the security deposit within 45 days. When asked, they said they would return the deposit in 60 days, in accordance with the lease.

I took them to small claims court and no one showed up. The court ruled in my favor, and now it is on me to collect money owed. I am not sure where to start finding information on how to move forward.

Can I send the landlord an email with the court judgement and request that they pay me? Do I have to go straight to filing garnishment?

Thank you

Boundary Tree

Location: Atlanta, Georgia. I have a boundary tree between me and my neighbor's house (trunk mostly on my side of the line but 20% or so on hers, which I've read makes the ownership equal). It is a huge old tree and has been dropping branches on my neighbor's house and car for a while before I bought the house (no damage since I moved in about 9 months ago). She says it has destroyed her porch and she cannot park in her driveway. She wrote me a formal letter of concern about the tree, which I never received because the post office messed up delivery, but I can assume it's a written account of the damage the tree has done. She requested that I fill out a form for dead, dying, and hazardous tree removal permits in order to get the city to send an arborist out to assess the tree, so I did. The arborist's report came back approving a permit for removal because "A few structural roots were cut and damaged at some point near the neighboring driveway". I clarified over email with the arborist that this meant her driveway caused the damage, and he said "It looks like a few structural roots were cut when they put in the driveway. There is no mandate from the City to remove the tree at this time. The permit is valid for 6 months from the issued date." The driveway was put in before my neighbor moved into her house. She wants the tree to be removed and costs to be shared. I am wondering if I am obliged to contribute to the cost of removal because it is partially on my property, even though the whole reason the tree is dangerous and drying is because of her driveway. I am fine with the tree coming down since that's what she really wants and it does appear to be damaged, but the expense is just not in my list of priorities being a new homeowner. If she insists the tree come down either way, would it be reasonable for me to give permission but not contribute financially? If she decides not to take the tree down if I'm not contributing and something happens like it drops another branch on her house or mine, who is liable for that? What are my options here?

Real Estate law [CA] Relative wants me to see a notary to "clear my name from the title" of a house I transferred to her via quitclaim deed, does this make any sense?

Location: California. My grandmother passed away in 2020 without a will. At this point I learned that in 2012 (which would've made me 7 years old) she put me and another (much older) relative on the deed to her house alongside her in lieu of a will, I guess. Once my grandma died this other relative immediately moved in, and has been living there since.

My relative has left the house in complete disrepair and hasn't paid any taxes or bills. Over the past two years she's been attempting to harass me into agreeing to a home equity loan, which I've been incredibly uncomfortable with for many reasons. This relative has a history of stealing from family members. She was putting me in a really tricky position so early this year, I decided to fill out a quitclaim deed. Several months prior I'd obtained a copy of the grant deed my grandma filled out, which I used for reference. My father (who used to work in real estate) instructed me to put my grandmother's name alongside my relative's on the new quitclaim deed since it was never removed from the deed once she passed.

I sent the forms via mail alongside a money order for the fee. It got rejected and sent back to me due to the fee amount I sent having been incorrect. I had a friend take it back to the Assessor-Recorder-Clerk's office in person so she could pay there, turns out the amount I sent initially was correct and it getting rejected the first time was an error on their part. My friend said it was being processed, in her words "They said it will take a few days for it to be public record or something."

I expected that to be the end of that, and said I'd effectively forfeited my stake in the property. Tonight my relative sent me this text message:

"Hi so they need to send a mobile notary to you for escrow I know you did the quit claim deed but some shit happened when the judge signed and he still gave the house to me and you . The mobile notary is to clear your name from the title not to get you on the loan

They need your contact info if you could send it to guysname@lendingcompany.com he can set up the notary to go to you"

Does this make any sense? I'm very hesitant about all of this since I wouldn't put manipulating me past her, but since she wants me to contact someone from the lending company she's working with I'm not sure. Sketchy either way, although the company seems legit from my very surface level research.

Can I choose my own custody?

My dad is a narcissist. He denies me any medical care because he thinks, as a chiropractor that will fix everything, I have some sort of vaginal infection and my refused to let me go to a doctor. He claimed he would disown me if I went, and I told a teacher who mandate reported me. My principle called my dad saying if I’m denied medical care it’s neglect and he would have to call cps. My dad played along with it just to get very very mad at me and saying I cant go and then switching the story to how I have to go immediately. My mom is suing for medical custody since their current divorce agreement is they both have to agree before doing anything medicinal. My mom said to show my principal the texts between me and dad because it will help her get the mc if it is documented, but I just think he will find out and take it out on me. What do I do?

Wife Denied Entry To Concert Due to Disability

5.7k Upvotes

Location: Illinois

Yesterday my wife and I went to Hollywood Casino Aurora in Illinois for a concert and my wife who has an implanted defibrillator and pacemaker and cannot go through metal detectors or be wanded due to the complications it could cause to the hardware attached to her heart, was denied entry to the concert. We showed them her medical card that clearly states she can’t go through the metal detectors or be wanded but they kept trying to push the point and get her to allow them to wand her. Normally in these situations like when we go to the airport, sporting events, other concerts, the cruise we just went on, amusement parks, you name it, they always just pat her down before they let her in. In this case they refused to pat her down and said the only way she can come in is if she gets wanded or goes through a metal detector. I brought up the Americans with Disabilities Act and how it says they have to do an alternative method to allow her to enter but they claimed that the state gaming law supersedes federal law which I’ve never heard of before.

Is this something I should pursue legally? I whole heartedly believe what they did is discrimination to a handicapped person

Real Estate law Mortgage Takeover

• Upvotes

Location: Pennsylvania

My husband and I moved into his grandmothers house a year ago with a rent to own lease that would last 15 years. Though his grandmother has been really pushy from us moving in to take over the mortgage as she “doesn’t want to deal with it anymore.” We are not against this as we have a lot we need to get done with the house and understand there’s a lot of issues when we are not the owners. Obviously being young and us having debt will not get us the interest rate she currently has. I believe we would be able to get a mortgage if that’s the only option, it’s just also the least desirable option with my understanding.

So, my question: is there a way for her to pass the mortgage (with her 3% interest rate) to us by adding us to her mortgage and eventually removing herself? Is the only option to open a new mortgage in our name? Or is there some other option I don’t know about as this is our first attempt at purchasing a home?

Contracts Contract for Handy-Man work.

• Upvotes

Location: Illinois.

I have been contacted by a member of my close friends family to do some small scale Handy-Man style work. Painting, fixing a few stair steps, hanging trim, etc. My friend has very high tensions with this member. However I acknowledge that the last time I did work I messed up and I am going back to fix it out of professionalism. So I am wanting to cover my ass with a contract basically stating that I am not a licensed worker and that the work is all I am doing, including a section about payment. However where I am running into a bumble. I have no idea about how word/format a contract. So I am asking how I should approach this situation in a way that will not exacerbate the situation. Im not 100% sure if this is the right place to ask but might as well try.

my mom's husband can't go to court.

• Upvotes

Location: Maryland, United States

i don't really know where to put this. apologies if the flair is wrong, or something.

my mom's husband is dying of late-stage liver failure. [technically my stepdad, it's complicated]

he was divorced a while ago and is unable to pay alimony to his ex because he lost his job and none of us are working due to very complicated situations - we're at risk of losing housing and my mom had to quit her own job due to extreme mental health issues as a result of everything happening. i'm trying to find employment but jobs are shit right now.

stepdad is in hospice care and is taking heavy pain medications that are aiding in his deterioration mentally. he gets confused over things like the time of day, who owns his cars, stuff like that.

his ex is trying to take him to court but i don't really know what she expects. my mom's trying to make people understand that he cannot go to court. he can barely make it to the bathroom without falling over, or answer questions from my mom without freaking out. i just want to help her out, she's been dealing with a lot.

my question: is there a way we can prove that he's incapable of showing up to court? if we do, what happens next? if we could pay alimony, we would have. [his ex isn't hurting for money, either, so i've heard, but that's another note]

if we can't prove that, then what happens? how are we meant to get him to court at all?

federal investigation

• Upvotes

location: Illinois lake county

I have been under federal investigation in Illinois since 2024. I have lost everything; my family has turned its back on me, and I cannot find work. I have been homeless due to this situation but currently am not. I do not know the investigation’s basis. The possibilities I can identify are that my mother lied amid a contentious court matter involving my children and her, or that I associated with a dangerous person, unaware of his identity. At the time, I did not know his background or understand his character. I angered him, and he later threatened to kill me and get revenge. this started while i was living in lake county Illinois now i live in southern Wisconsin on the boarder of Illinois and Wisconsin. i don't know what to do and have no money for legal help. can anyone point me in a direction that i can get help for this on going matter? or any advice at all?

[CO] Landlord kept $325 of our deposit for turnover cleaning, and sent photo "proof" that isn't even our apartment.

• Upvotes

Location: Arvada, CO

Moved out of our place in Arvada (Denver suburb) recently. We spent hours cleaning, got the carpets professionally shampooed, and handed over the keys. Management just hit us with a flat $325 cleaning fee, deducted out of our $500 deposit.

When we pushed back, they sent their inspection photos. It's stuff like dust on top of baseboards, lint on the ceiling bathroom vent, water spots on the shower handle, and grease in the bottom of the oven.

The thing is they included a picture of dirt & hair behind the fridge... except the photo can't be our apartment. In our unit, the wall was to the left of the fridge and the kitchen counter was to the right. In their photo, the wall corner is on the right and the counter is on the left. Looks like they sent us a picture from a completely different mirrored unit.

We emailed back saying ambient dust is normal wear and tear under Colorado law (C.R.S. 38-12-102), and moving plumbed appliances isn't tenant maintenance. They just replied: "The photos previously sent show that there was a clear need for cleaning and we addressed. This will not be reimbursed."

Since they're digging in, I'm getting ready to send a formal 7-day demand via certified mail today under C.R.S. 38-12-103 seeking triple damages ($975). If they don't refund the $325, we'll file in Jefferson County small claims court.

Anything I should do differently? Anything in these photos that shows "abuse" or "neglect?" They charged use separately for the adhesive hooks, and I'm not disputing that. Is this just a major waste of time? They sure are being scummy about this, I really want that money back!

Concern for change in claim

• Upvotes

Location: Illinois

Hey everyone, I happen to somehow get my Instagram account disabled under their community guidelines “self-injury” I checked what I wrote and post and none of which has anything to do such in self harm. I got a new full exhibit index of proof it isn’t self injury but I couldn’t include it in the original claim because this new evidence came in after I submitted the demand packet.

I filed arbitration because I really want the account back, we finally finished the selection of arbitrators and got a pre-hearing conference on early November. My legal team told me it’s difficult to go against it despite they have the right to terminate, but told me my best chance was to put breach of contract for the cause of action in my claim, where they still have a duty to review the appeal properly. All my evidence wouldn’t be relevant if I didn’t state the breach of contract and I didn’t include it in my original claim, I just explained how it happened and that I demand the account back.

Do I need to request to amend my claim? Or can I just write the breach of contract though the written submissions phase of the arbitration? I don’t want the opposing party to argue they were blindsided even though it’s relevant to the case. I know for a fact the opposing party is just going to object to it so I might as well just go straight to asking the arbitrator in the pre-hearing conference if he will allow it.
