MITIE

Has any other guard who TUPE'd over to MITIE from ASDA noticed they have breached the contract they signed?

So far now theres been a few indications that MITIE have breached the contract at my store with me & other colleagues

What can we do about it?

Sadly Mitie is getting blamed for things that Asda has caused . Tupe over to Mitie send over contracts . Then Asda reduce total weekly hrs and Mitie have to sort it out. Asda has let everyone down . Asda has wiped their hands of us

I was getting my hours fine and there was no need to cut back for any reason nor was i contacted by them over it but they essentially took 2 days off of what i was doing weekly without notice , it was only when i tried to clock in for a shift i realise they took it off me completely dropping my contracted 30hours/week to 18 ish

Tried to contact them but radio silence

Contact your manager they can't cut your hours without permission or discussion.

If you read the fine print of your MITIE contracts, they absolutely can.

We don't have Mitie contracts we have Asda contracts tuped over to Mitie. They have the same term and conditions as before.

No they don't, they're 2 separate companies and have 2 separate T&C's. TUPE doesn't work the way you think it does.

Literally you have to consult on term and condition changes or you will fail in court. And Tupe does work like that it stops employers behaving exactly like this and misusing contract changes to cut hours and the such. Legally it's illegal to cut hours without permission in uk, unless your employer has a valid reason like liquidation. And no it's also illegal to tupe then cut hours as term and condition remains the same. The ETO reason that's being used has to be you need to prove that you have a surplus of Security, which I doubt 2 staff on shift would legally be seen as surplus. I also doubt you could prove massive drop in probability when the contract literally makes the you more profitable.

Asda lied we all had S.I.A licences..... Costing £600k to sort, Mitie say Asda should pay.

In-house security don't need an SIA licence and Mitie knew as many didn't as before the takeover date, they already had plans to charge everyone who didn't have one, for their licence. Mitie must have now realised they can't charge for the training so it's their own fault.

That was one of the things i had them confirm if i had to pay anything as i was told we didnt by the GSM then the mitie tupe said we did so i hadnt signed it until i had confirmation we didn't have ti pay

You drop in store hours could be the stores security level. High risk get the full hours medium and low get considerably less. Mine dropped to a medium so ours were cut and the guard who was at us now does a few shifts at b&q

Think ours is classed as high since its one of the 24 hour stores during weekdays (which i mainly worked)

If it helps ask the customer manager to get the gsm to re enable your asda appriss log on and log jobs like mad. Im logging everything and anything security related. As they are using that metric to assess the hours I think. Also if you type in Mitie on the asda search bar you can check your sites specific contracted guarding hours. My old checkout section leader showed me.

Absolutely theyre breaching the contract, few other lads from the stores have been given horrendous hours that dont even add up to their "protected" contract hours

Well there was a team call saying there are going to be possible deployment and redundancy

You will find it’s Asda that reduced the hours not mitie . Nobody has signed any contracts
Mitie has the contract for 5 yrs . If you speak to GMB they’ll agree Asda has played us all to save money

Mitie, the company that's taken over Asda security.
