Gotta work on that reaction time. Of course I’m not saying it’s the POV drivers fault at all. But anyone could have seen that coming from a mile away.
412
u/InevitableOk5017 3h ago
Came to say this. That could have been avoided by faster breaking and even lane departure if you know no one is beside you. Not blaming the driver it was obvious the other drivers fault.
228
u/Gesha24 3h ago
Changing lanes is one of the easiest ways to become at fault in the accident. Of course one should change if they have time and they are absolutely sure there's nobody next to them, but otherwise it's usually better to just slam on brakes in your lane. Big exception for this - if you are about to crash into something that can severely hurt you, in this case you are more worried about saving your life/health rather than who is at fault.

u/Remarkable-Pea5797 3h ago
If you're constantly aware of all of your surroundings and are paying adequate attention, you shouldn't have to guess if the lane is open next to you, you would know. I hate when people hang out in my blind spot because of this.
77
u/Cinderbunni 3h ago
THIS! That's how I was taught to drive. A full and quick scan every 30 seconds. Who is on my right, left, who is behind me. People drive like zombies... stare forward and fall asleep.
→ More replies (8)47
u/myfatherthedonkey 3h ago
The situation can change significantly in 30 seconds, no? You'd need to be checking every five seconds or less to constantly be certain who is around you at all times.
40
u/Global_Cress3879 2h ago
It can. I think one of the biggest problems is that 90% of people don't use their mirrors correctly. You shouldn't be able to see the sides of your car in your side mirrors, or at minimum just the rear. The point is to have your mirrors set up in overlapping fields of view.
I can watch a car approaching me from behind in my rear view until it goes into my blind spot, at which point it appears in my side mirror, then leaves my mirror view and enters my peripheral vision. I ALWAYS know what's around me without ever turning my head.
7
u/Informal_Ad4399 2h ago
Yes, this is the issue a lot.
I took a 1 day defensive driving course at a race track with race instructors. They explained proper mirror adjustments. Looking for and near when driving as well.
First half of day was obstacle avoidance at the last second using flaggers and gates.
Second half was lapping with a ride along instructor.
I already had a pretty good feel for my vehicle (I used my pickup truck for it all), but it helped with some areas I needed shoring up.
Even with a crew cab pickup, my blind spot is just a sliver of a spot. A quick glance to my side that doesn't even really require head movement, and I can see it. That is really a non issue if I'm paying attention at all. I can see someone approach, track them all the way, and know where they'll be. Even a lane change in the blind area is known because they don't appear in the mirrors when they should, or disappear into the spot.
The big thing they taught was avoidance. There are instances you can't of course, but avoidance is much easier if you're properly paying attention and can learn to not panic right away. A lot of people do.
If you can find a class like this near you, I highly suggest it. They're expensive, but if you can avoid even 1 accident by using what you learned, it's worth the cost.

u/ElfjeTinkerBell 1h ago
That doesn't work in every car. In my car, I can't get the mirrors set in any way that (especially) a motorcycle is visible in either the rear view mirror, the side mirror or my peripheral vision. That's not a problem, I know where to turn my head, but "without moving my head" I have a huge blind spot just by the way my car is designed.
→ More replies (1)17
u/BrunoBraunbart 2h ago
Yes but in this situation you see that car standing there and with experience you develop some kind of intuition that this car might do something stupid. This is when you check your surroundings and get ready to brake.
Obviously this doesn't always work and even though I'm a former test driver I can absolutely see myself reacting the same or worse but on a good day a good driver could have avoided this crash without taking any risk.
→ More replies (11)6
u/blue60007 2h ago
I mean there's always a chance someone could come blasting out of nowhere from behind, but you should still have a good idea without looking around every 2 seconds. Cars don't usually come out of nowhere in a few seconds (well, at least from behind). You'll see them coming up from behind or you pass them waiting to turn onto the road.
I think this is also a situation where if my choice is 100% chance of plowing into someone or a 5% a car came out of nowhere and is hiding in my blind spot, and sideswiping them, I know which choice I'm taking. Getting into a collision is a giant PITA no matter who is at fault.

To be certain, sure. To be reasonably certain? No. And that’s the best case scenario so that’s what we’re going for.
7
u/Gesha24 3h ago
I usually have a rough idea if there's somebody next to me, but in this situation I would not be able to say whether the car behind and to the right of me slowed down or not (they may have been on their phone and completely missed the situation). So if there's a car somewhere behind me - I am switching lanes only after I applied brakes and had a chance to look to the right.
3
u/Own_Expert2756 2h ago
Yup, try to avoid changing lanes into someone's blindspot and def don't just mindlessly cruise in it.
3
u/Interesting_Key_661 2h ago
If I could give more than one upvote to this comment I would. I’ll never understand people who linger in anyone’s blind spots. Either fall back or pass me.
3
u/mingk 2h ago
True, but changing lanes is still bad unless it’s a life or death situation. If you lose control then your car barrel rolls and the guy at fault just drives away. If you change lanes and smash the break causing someone to rear end you, you’re at fault. If you veer around an animal on the road just to hit a tree, you’re now at fault.

Believe it or not, a professional driver would be charged with that collision. The question asked of a pro driver is "what could the driver have done to prevent the collision". And, as everyone points out, there were plenty the POV could have done to prevent it.
Amateur drivers get away with a lot more than professionals do. Even when they break no law.

I would agree that she could have avoided it. I'm struggling to come up with why she shouldn't have, though.
16
u/snarksneeze 3h ago
All we can see is the forward POV, we don't know what was coming up beside or behind her. Switching lanes to avoid an accident can create another accident at which you would be at fault for not maintaining lane control. So I can't say she should have, but it looks like she could have.
23
u/Joeltron88 3h ago
No problem switching lanes after impact. Guess it was wide open.

It’s easy to say in hindsight that this could’ve been avoided. The minivan was being very unpredictable and second-guessed themselves based on its behavior entering the intersection. I’m going to guess she had a car to the right of her so the only thing she could do was break. There wasn’t enough time and distance for her vehicle to go at a complete stop to avoid that minivan. Avoidable or not, she is not at fault.

Feelings. Some people are governed by their feelings. Was in an accident with my father in law driving and he could have avoided it but got pissed at first by the other driver having the nerve to... oh shit we'll crash he soon realized after a few seconds and then it was too late to avoid it. Similar situation as this (really old guy in an old heavy American car was at fault). Had he been cool he would have had a couple of seconds spare to brake before the crossing. Always assume the other drivers are idiots, drunks and half blind and act accordingly.

u/ProjectDv2 3h ago
You're not saying it, but I am. She absolutely could have avoided it, and because of that she absolutely should have. You have a responsibility to avoid collisions on the road, full stop. Whole the other guy was an idiot for pulling it into traffic without paying attention, apparently she wasn't paying attention either. I guarantee, if the insurance company is shown this footage, she will be declared a not insignificant percentage of the fault.

You can see that little silver Yaris or whatever it is inching out for like 10 seconds before the impact. She was definitely not paying attention to the road, especially by a school like that. Looks like HS students getting out, recipe for disasters like this.
8
u/Degenerecy 3h ago
I agree on the inching out part but the school light wasn't flashing. I know they aren't 100% as ours for a couple years stopped working because the city didn't want to pay the programmers which was done by the local college.
However it is noon and it could be HS students gong out for lunch hour so it is possible though. Still, 100% avoidable.

Defensive driving requires tracking everything that could be a hazard 10 to 15 seconds down the road. It is just good practice to make a mental note of any vehicle that is positioned to pull out and monitor them as you approach. Yeah, it doesn't always work, but could have in this situation.

Driver was braking within 2 seconds of the car pulling out. That’s a normal human reaction time. I counted about 3 seconds from when the car starting pulling out to when the accident happened. Considering it takes about 4 seconds to react and brake completely at 40 mph, it doesn't seem that bad. By pulling out so slowly, it made it really awkward to avoid since you can't tell if they're going to stop, in which case you can avoid to the left, or keep going so that you can avoid to the right.

Exactly imagine if it wasn’t a car but a child. You need to have reaction time. She drives like a 90 year old behind the wheel. Dangerous for everyone on the road

A lot of time to slow down. A lot of time to slam on the brakes. And a lot of time to avoid the other car by swerving to the right.
Correct me if I'm wrong, as I'm not a lawyer nor am I two insurance companies battling it out, but I think the other insurance company is going to do whatever they can to lower the percentage of responsiblity their client holds. I think it's something like determining comparative fault. And they might be able to do that based on OP's wife having plenty of time to stop, or at least try to stop by slamming on her brakes, or swerving, or really anything to avoid the accident, but didn't.
They might not claim it was outright the fault of OP's wife, but they'll try their hardest to get some sort of split here by lessening the responsibility of the car that pulled out and placing that squarely back on OP's wife. Unless my understanding that it's everyone's responsibility to do whatever they can to avoid an accident is incorrect, they may actually have a claim for something like an 80-20% split here (numbers are made up to make a point, not exact numbers; 80 other, 20 OP's wife). Especially if they see this video themselves.
Again, I don't know for sure, but that's my understanding of how things can play out in some of these cases.

Well yeah, obviously the car was creeping out, but, at least driving in LA, people be doing that. Pulling out into a lane that's free preparing to make a left turn after the next lane frees up. It's really fucking annoying because there's a part of me that's wondering if they're gonna do the dumb shit the blue car here did.
That is to say, I can totally see how it would be unexpected for this car to keep creeping out into a lane where a car would be instead of just up to the edge of the free lane, if that makes sense.

Here comes the idiot thinking that driver A should be exempt from all criticism just because driver B is the one who caused the accident.

Nobody in the comments is blaming the cammer. They are, however, pointing out that she had plenty of time to avoid it all together. There's a difference.

Idiots? You mean people who know how to drive, how to anticipate dangerous situations? People who know how to read the road and act accordingly?
But I guess this video is an example of what you get when uncle Joe is your "driving instructor"

So I’m usually you in the comments and while I’m not blaming the cam car this accident may have been avoided by being more proactive with the brakes and slowing down. When I’m approaching situations like this, im hovering my foot over the brakes and watching the other driver closely - where their eyes are looking, where their tires are pointing, are they stopped or edging forward etc.
In this case, the cam driver had enough time to brake and let the stupid can go by. But not the cam car’s fault the accident happened. While it’s not, I think drivers also have a duty of care to avoid accidents if they safely can.

why are so many blaming the reaction time
ofc it wasn't the greatest and it could be avoided, but it's still not op's (wife) fault..
why mock the victim

I’m not putting blame on op but there are two lanes. If they had been paying attention to the road fully they easily could have switched lanes. Or breaking right away would have helped too. Not assigning blame to a person driving in their own lane but still. I mean did you want to teach them a lesson?
Edited for punctuation.

Still turning vehicle 100% negligent
Doesn’t matter how late she braked

Parking on the sidewalk makes me think the driver behind the cam is a fucking idiot.

This was 100% avoidable.
Anytime I see a car - I just assume they are going to pull out.
If they don't then I'm pleasantly surprised.

Why did she pull onto the sidewalk and someone's lawn? Is your wife "slow", u/Superior_Seeker_ ?

These things are hard because the dash cam makes it hard to see what reaction is happening. However, if I look at the level of the curb along the edge of the video frame it appears to be a second and a half where we can both clearly see the car pulling out and the curb not move relative to the frame. That says in a second and a half there was no significant braking occurring.
That seems too long to be reaction time. It appears that she either wasn’t paying adequate attention or was being aggressive about her lane space and then got caught by the other driver’s inability to clear the lane in time.
So while the other guy clearly pulled out into traffic unsafely, I think your wife didn’t adequately act to avoid him.
